The Phoenix Union High School District (PXU) passed a resolution declaring its right to refuse entry to federal immigration officials on school grounds.
During a special meeting last Friday, the PXU Governing Board unanimously passed its “Safe Zone Resolution” which designated PXU as a “Safe Zone.”
Under this “Safe Zone” designation, the governing board claimed, PXU officials reserve the right to deny Immigration and Customs Enforcement (ICE) entry to any campus.
The governing board required ICE — as well as any state or local law enforcement agencies acting for ICE — to submit a request to Superintendent Thea Andrade or her designee for review. PXU asserted that Andrade or her designee had the authority to review whether each requested instance of campus access by immigration enforcement would be permitted by law or would require a judicial warrant.
Similarly, PXU required immigration enforcement agents to go through Andrade’s office to request student information.
PXU further claimed in its resolution that their district doesn’t maintain any data relating to students’ immigration status, characterizing the distinction as “potentially discriminatory” and “irrelevant” to education. The district declared that all students “regardless of immigration status” had a right to free public K-12 classrooms, even claiming that illegal alien minors had “other legal grounds for presence” in the country. The district resolution didn’t clarify what those were.
“[F]ederal immigration law enforcement activities, on or around District property and transportation routes, whether by surveillance, interview, demand for information, arrest, detention, or any other means, harmfully disrupt the learning environment to which all students, regardless of immigration status, are entitled and significantly interfere with the ability of all students, including U.S. citizen students and students who hold other legal grounds for presence in the U.S., to access a free public K-12 education,” stated the resolution.
The resolution was submitted before the board for approval by PXU general counsel, Eileen D. Fernandez.
Fernandez formerly served as the associate general counsel for Orange County Public Schools from 2010 to 2021.
The Trump administration has already indicated its intent to bring accountability to those who hinder immigration enforcement efforts.
The day after Trump’s inauguration last week, the Department of Justice (DOJ) issued an internal memo warning that all laws and actions “that threaten to impede” the Trump administration’s immigration initiatives were to be considered threats to public safety and national security.
The DOJ directed its Civil Division within the Office of the Associate Attorney General to identify and take legal action against state and local laws, policies, and activities serving as noncompliance to the Trump administration’s immigration initiative.
That memo also launched investigations into state or local law enforcement officials believed to be interfering with immigration enforcement.
“[I]n the absence of unusual facts, prosecutorial discretion at the Department of Justice and the U.S. Attorney’s Offices is bounded by the core principle that prosecutors should charge and pursue the most serious, readily provable offenses,” stated the memo from Acting Deputy Attorney General Emil Bove.
Bove’s memo declared that all state and local actors were required by the Constitution and federal law to comply with Trump’s immigration enforcement initiatives. The DOJ said that noncompliance would trigger federal investigations and, likely, prosecutions.
“Federal law prohibits state and local actors from resisting, obstructing, and otherwise failing to comply with lawful immigration-related commands and requests pursuant to, for example, the President’s extensive Article II authority with respect to foreign affairs and national security, the Immigration and Nationality Act, and the Alien Enemies Act,” stated the memo.

An Arizona Congressman is cheering on a recent court decision involving the sale of border wall material by the outgoing presidential administration.
U.S. Representative Eli Crane marked a judicial opinion from the United States District Court for the Southern District of Texas in The General Land Office of the State of Texas v. Biden. The case involves a challenge to the Biden administration’s efforts to sell unused border wall materials ahead of President-Elect Donald J. Trump taking office on January 20, 2025. The ruling from Judge Drew B. Tipton granted the plaintiffs’ Motion for Preliminary Injunction.
Crane responded to the legal outcome, writing, “Solid victory. Thanks to President Trump, our border will be secure again. Arizonans can’t wait.”
President-Elect Trump, who had desired the courts to weigh in against the Biden administration’s actions, said, “BREAKING: In a major, crucial WIN for America, and our National Security, a Federal Judge in Texas, based on papers we filed just a few days ago, has PROHIBITED the Biden Administration from selling any materials designated for the Border Wall, that has been wrecked by Biden and his cronies, and which I am going to rebuild in order to protect our Country from violent migrant crime, fentanyl smuggling, sex trafficking, terror attacks, and other heinous, Nation ending disasters.”
Trump added, “The Judge has also ordered an investigation into the illegal selling of the materials, which will expose just how corrupt and anti-American Radical Democrats are. I am honored to be joined in this vital case by the Great States of Texas and Missouri, and applaud Judge Drew Tipton for doing the right thing for our Country. We have to protect our Borders, and Save America. MAGA!”
“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” said Texas Attorney General Ken Paxton. “This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda.”
Arizona Senate President Warren Petersen, who has been eyeing a potential run for state Attorney General in 2026, noted the District Court opinion, saying, “Conservative AGs matter.”
The court ruling followed a shocking report by The Daily Wire, which revealed that “Biden is racing to auction off unused border wall materials weeks before Trump takes office.” These materials were left over from the first Trump administration, when President Biden halted construction on the wall spanning parts of the southern border in various border states as one of his earliest actions in the White House in early 2021.
Trump said at the time, “The (Biden) administration is trying to sell it for five cents on the dollar – knowing that we’re getting ready to put it up.” Trump added that “what they’re doing is really an act – it’s almost a criminal act.”
Former Arizona Governor Doug Ducey responded to the news, saying, “Right here in AZ, Joe Biden is attempting a last-ditch effort to keep America’s borders open by selling off materials the Trump Admin will use to finish the wall. This decision from President Biden is reckless, will make Arizonans less safe, and should be reversed – immediately.”

One member of Arizona’s Republican congressional delegation is standing strong for the hopeful Pentagon head under the new presidential administration.
Last week, U.S. Congressman Eli Crane signed a letter in support of Pete Hegseth’s nomination to lead the Department of Defense when the Trump Administration assumes control of the nation on January 20, 2025.
The letter was signed by 32 veterans in the United States Congress and was sent to Majority Leader-elect John Thune and Majority Leader Chuck Schumer in the Senate.
In the letter, the lawmakers wrote, “[Hegseth’s] ability to communicate across institutional landscapes – with military leadership, congressional representatives, and frontline troops – will set him apart. His media expertise and transparent communication style will be crucial in executing a clear vision that cuts through bureaucratic inertia. As a decorated combat veteran of the Iraq and Afghanistan campaigns, he offers an authentic understanding of modern warfare. His Harvard and Princeton credentials, combined with battlefield experience, forged a rare intellect aligned with President-elect Trump’s strategic vision, to bridge the gap between the beltway and frontline realities.”
The letter added, “Despite relentless media attempts to undermine Mr. Hegseth’s nomination, we call on the Senate to honor its constitutional duty of advice and consent by conducting a fair, thorough confirmation process that evaluates his nomination solely on its substantive merits – his distinguished military service, academic credentials, and a bold vision for revitalizing our national defense. The integrity of our democratic institutions depends on allowing this critical process to proceed.”
The congressional co-signers concluded their communication with an unequivocal statement of support for Hegseth, noting their confidence that “he will transform President-elect Trump’s vision into reality, safeguarding America’s national security interests with courage, intellect, and unwavering commitment.”
When President-elect Donald J. Trump nominated Hegseth last month to serve as the next Secretary of Defense, he said, “Pete has spent his entire life as a Warrior for the Troops, and for the Country. Pete is tough, smart and a true believer in America First. With Pete at the helm, America’s enemies are on notice – Our Military will be Great Again, and America will Never Back Down. … Pete has also led two Veterans Advocacy organizations, leading the fight for our Warriors, and our great Veterans. Nobody fights harder for the Troops, and Pete will be a courageous and patriotic champion of our “Peace through Strength” policy.
Hegseth is currently navigating an uphill battle in the U.S. Senate to secure the necessary votes he needs for cabinet confirmation in January with the 119th Congress, which will feature Republican control in the upper chamber.
Crane is finishing up his first term in the United States House of Representatives after being elected to Arizona’s Second Congressional District in November 2022. He is a military veteran of the United States Navy, serving thirteen years, including on SEAL Team 3. Before entering Congress, Crane also operated a small business.
This past November, Congressman Crane sailed to reelection over his Democrat opponent, with almost 55% of the vote. He serves on the Committees on Homeland Security, Veterans Affairs, and Small Businesses. He is also a member of the House Freedom Caucus, Western Caucus, and Copper Caucus.
