In the tumultuous race for the Maricopa County Attorney’s Office, the incumbent Republican Rachel Mitchell is facing attacks from both sides as fellow Republican Gina Godbehere, a former bureau chief for the MCAO and former prosecutor in Goodyear was first to launch a blistering campaign. However, by comparison the findings of investigative reporters against Godbehere are far more serious than those she’s levied against Mitchell.
The victor in the upcoming July primary will face off against Democrat Tamika Wooten, a judge pro tem, former chief prosecutor in Glendale, and a municipal judge in multiple jurisdictions. But before Wooten has even taken the stage, the GOP primary campaign has already been marked by the weapon of choice for any Attorney’s race: ‘sweetheart’ plea deals. Godbehere fired the first shot, blasting Mitchell for a plea deal with former director of the Arizona Department of Corrections, Rehabilitation and Reentry, Charles Ryan in a radio interview with KFNN’s J.D. Hayworth as reported by the Phoenix New Times on April 9th.
Godbehere prefaced the issue telling Hayworth, “The problem with the county attorney is she’s wedged between a Democratic governor and a Democratic attorney general, and she has liberal staff that are running that office.” She later landed the rhetorical blow, “When you allow sweetheart deals, like in the Ryan case or pointing the gun at police, and you’re not holding offenders accountable, this is the problem we’re having.”
As noted by New Times, Wooten also latched onto the plea deal telling the outlet, “As a prosecutor, justice is supposed to be blind, and (Mitchell’s) not making her decisions that way. I think there was definitely some favoritism based on Ryan’s former position.”
It didn’t take long though for the investigative reporters at the Arizona Daily Independent to uncover a troubling unsolicited plea deal issued by Godbehere during her tenure with the MCAO for 52-year-old Laquanza Young, also known as Quan Chaney before changing his name in 2019. As reported by the Independent, Young (then known as Chaney) was arrested in 2009 for attempting to rob his former employer Cricket Wireless, threatening a pregnant former co-worker at gunpoint while doing so. He had been previously terminated by Cricket on suspicion of theft and for weeks ahead of the robbery reportedly sent threatening emails to his ex-employer.
Young was arrested and was looking at 3 counts of aggravated assault, burglary, and armed robbery charges, class three and two felonies respectively, and had a lengthy criminal record. Depending on mitigating facts he should’ve been looking at up to 30 years in prison. Confusingly, Young even expressed in pretrial statement that he had no interest in a plea deal. That was at least until Godbehere took the case.
According to the Independent, “Godbehere promptly gave Young a five-week continuance for his trial date, and then offered him a plea deal. Instead of felony charges for aggravated assault, burglary, and armed robbery, Godbehere offered Young lesser charges of disorderly conduct with a handgun (a class six felony) and burglary in the first degree with a handgun (a class three felony). Minimum sentencing under the revised charges amounted to three years, or a maximum of eight years. Godbehere personally signed off on the plea deal.”
Young (then Chaney) was sentenced to just 10 months in prison, was out in five, and he only paid $400 in restitution to the pregnant mother he threatened.
Already, this would be egregious. But on March 21, 2024, Young now under his new moniker, drew a firearm on Scottsdale Police officers who had pulled him over during a routine traffic stop. The suspect was driving a vehicle that had been reported stolen at the time of the traffic stop according to AZCentral. Near Scottsdale Road and Cactus Young exited the car rapidly, drew his gun and opened fire on two officers who returned fire and struck him fatally. He was declared dead at the scene.
A man who was only on the street due to an unsolicited plea deal from Godbehere, was killed just weeks ago while he attempted to murder two Police officers in the line of duty.
Without expressing an opinion regarding the plea deal that Mitchell offered Ryan, a charge based on an incident in which no one was harmed being reduced in light of a dedicated civil servant’s years of service doesn’t strain imagination. But an unsolicited, astoundingly light plea bargain, putting a known criminal back on the street who would later die attempting to gun down two police officers is quite another matter.
To quote Godbehere’s own words, “When you allow sweetheart deals (…) and you’re not holding offenders accountable, this is the problem we’re having.”

Many Arizona government officials marked the solemn Memorial Day holiday.
Senator Sonny Borrelli said, “As we head into the Memorial Day weekend, I know many of you might be marking the occasion with barbecues, parties, trips to the lake, and maybe even parades. During this time, I hope you’ll also take a moment to reflect on brave men and women who’ve selflessly served our country and paid the ultimate price so that we can have the freedoms we enjoy today. I served as a Gunnery Sergeant with the U.S. Marines, and l’ve lost a number of brothers and sisters in the military, so this is a somber time for me. We always knew the dangers we would be facing, but we did the job anyways because we love our country.
Borrelli added, “Across the street from the Arizona Capitol at Wesley Bolin Plaza, you’ll find a variety of memorials honoring those who’ve served at Pearl Harbor, in Vietnam, in World Wars 1 and II, the Korean War, and Desert Storm. I encourage you to make a visit sometime. Freedom isn’t free. God bless the fallen.”
The Arizona House Democrats Caucus “X” account shared, “Today, we honor and remember those who made the ultimate sacrifice for our freedom. Don’t forget to reflect and appreciate what Memorial Day is truly for.”
Governor Katie Hobbs posted a video to pay tribute to the solemn holiday, writing, “On Memorial Day, we come together to memorialize the brave men and women who laid down their lives for us. Today, I encourage every Arizonan to reflect on their lives and think about how they give back to their communities in their honor.”
The “X” account for the Office of the Arizona State Treasurer noted, “Arizona Treasurer Kimberly Yee honors and recognizes the brave men and women who made the ultimate sacrifice for our freedom.”
The Arizona Senate Republicans Caucus’ “X” account said, “Freedom comes at a high cost, and we must continually protect it as Americans. Thank you to the heroes who sacrificed it all for our country.”
Attorney General Kris Mayes added, “Today we honor & mourn the brave souls who gave their lives defending our country – the ultimate sacrifice. May we reflect on what they fought for, today and every day.”
House Speaker Ben Toma stated, “Today, we honor and remember the brave Americans who made the ultimate sacrifice for our freedom. Let us keep them in our hearts and minds this Memorial Day. God bless the departed, their families, and those currently serving protecting our great country.”
Phoenix Mayor Kate Gallego said, “On this Memorial Day, we honor the fallen heroes who gave their lives for our nation. We will always remember their courage and dedication.”
The Maricopa County Attorney’s Office shared a video from County Attorney Rachel Mitchell, writing, “On Memorial Day, we reflect on the bravery of those who gave everything for our freedom. We think of their family and friends who’ve lost so much so our communities may thrive in peace. Today, we honor and remember them.”
Peoria Mayor Jason Beck posted, “On this Memorial Day we remember and honor the brave men and women who lost their lives defending this great country. Let us never forget their courageous sacrifices in the pursuit of freedom.”

Maricopa County’s top prosecutor is cracking down on a foreign group committing home burglaries across the Valley.
Earlier this week, Maricopa County Attorney Rachel Mitchell announced “new charges against a group of thieves targeting homes in Phoenix and Scottsdale.” Mitchell’s office shared that “the defendants are thought to be part of the South American Theft Group, a ring of thieves who hire Chilean nationals to come to the United States and – after obtaining false identification – operate as ‘crime tourists’ who plan and execute burglaries here and nationwide.”
Three defendants were arrested in Scottsdale this month, and another three were arrested in Phoenix last month.
In a statement, Mitchell said, “The Scottsdale and Phoenix Police Departments have done some amazing work to find these criminals and arrest them. The job of my office is to hold them accountable. This is not a phenomenon limited to Maricopa County – these organized groups are stealing from families across the nation. I will not allow them to become entrenched here and pose a further threat to our neighbors.”
According to the Maricopa County Attorney’s Office (MCAO), “The South American Theft Groups are made up of people who travel from South America specifically to target homes and families in the U.S. The federal government’s tourist visa program allows them to fly into the United States without a background check. Once they’ve entered our county, they immediately obtain fake I.D. They travel to cities across the nation – including in Maricopa County – and steal millions in untraceable items.”
The Scottsdale Police Department announced the apprehensions on March 11.
The MCAO reports that “there have been over 100 similar types of burglaries valley wide since November 2023” – of which, 35 have victimized the city of Scottsdale. The Office also revealed that “one defendant admitted to being in the U.S. on a tourist visa and had already been a part of burglaries in California, Nevada, and Arizona.”

The Arizona Legislature continues to work on solutions to crack down on organized retail theft across the state.
Last week, the Arizona Senate overwhelmingly passed SB 1411 with a 22-4 vote (with four members not voting). The bill would “require the Attorney General to establish the Organized Retail Theft Task Force to combat crimes that relate to stealing, embezzling or obtaining retail merchandise by fraud, false pretenses or other illegal means for the purposes of reselling the items” – according to the purpose from the chamber.
After the vote, Senator David Gowan, the bill’s sponsor, issued the following statement: “California has been forced to invest hundreds of millions of dollars to fight an enormous rise in organized retail crime because of their liberal policies that oppose holding people accountable for breaking the law. Businesses have been forced to shut down and pull out of the state. We don’t want to turn into California, but unfortunately Arizona is also experiencing a rise in these crimes. We need to get ahead of the issue to prevent going down the same path, which is why I sponsored SB 1411 to establish a task force to combat crimes that relate to stealing, embezzling, or obtaining retail merchandise by fraud, false pretenses, or other illegal means for the purposes of reselling the items.”
Gowan added, “The task force will be comprised of federal, state, and local law enforcement, in order to use their combined skills, expertise, and resources more effectively. This bill passed out of the Senate with strong bipartisan support. We all want to protect our businesses and keep our communities safe from theft.”
Last month, the bill passed the Senate Committee on Military Affairs, Public Safety and Border Security with a 7-0 tally.
Senator Janae Shamp and Representative Justin Wilmeth joined as co-sponsors for the legislation.
On the Arizona Legislature’s Request to Speak system, representatives from the Arizona Retailers Association, Arizona Attorney General’s Office, Arizona Food Marketing Alliance, Greater Phoenix Chamber of Commerce, and CVS Health signed in in support of the proposal.
SB 1411 now heads to the Arizona House of Representatives for consideration.
The efforts to shut down organized retail theft crimes continue the state’s already strong reputation on this front. Arizona already has another Organized Retail Crime Task Force, which commenced under former Attorney General Mark Brnovich’s administration and is also housed in the State Attorney General’s Office.
In December 2021, Brnovich wrote an opinion piece for the Wall Street Journal, warning would-be criminals of his office’s efforts to investigate and prosecute these offenses – especially in the wake of the lawlessness in Arizona’s neighboring state to the west. He wrote, “As Arizona’s attorney general, I have refused to capitulate to the lawless mob…We expect our efforts will deter such theft and hope our task force becomes a model for California and other states.”
Maricopa County Attorney Rachel Mitchell also has a strong presence against organized retail theft. In 2023, her office announced that it had made 354 bookings over these crimes, which was the most in the county since 2020. Additionally, in November 2023, Mitchell started a ‘Safe Shopping’ Campaign “to stop this fast-growing category of lawlessness.” Mitchell said, “Here’s what I say to the thieves who commit these crimes: we will find you, you will be arrested, and we will prosecute you to the fullest extent of the law.”

Late last month, the Arizona State House Judiciary Committee approved, HB 2435, which was sponsored by Speaker Ben Toma. The bill would “require a person who is convicted of a third or subsequent organized retail theft offense to be sentenced as a category two repetitive offender in certain circumstances,” according to the overview provided by the chamber.
HB 2435 passed the committee along partisan voting lines – 6-3, with all Republicans voting to affirm the legislation.
Before the committee’s vote, Toma hosted a press conference outside of the state capitol with Maricopa County Attorney Rachel Mitchell, who announced her strong endorsement of the legislation. Mitchell took to the platform “X” to share an update from the event, writing, “Thank you, Rep. Ben Toma, for your help in combatting Organized Retail Crime. If you plan to commit this crime, plan to stay. In Maricopa County, we will prosecute retail theft!”
Toma added, “California may tolerate lawlessness, but my bill, HB 2435, will tell criminals that they’ll pay a heavy price for stealing. A big shout out to Rachel Mitchell and AZ Retailers for working with me on this important legislation!”
In the Arizona Legislature’s Request to Speak system, representatives from Quiktrip, AZ Retailers Association, Combined Law Enforcement Association of Arizona, AZ Food Marketing Alliance, AZ Association of Counties, and the Greater Phoenix Chamber of Commerce registered their support for the bill. Representatives from the AZ National Organization for Women, State Conference NAACP, Rural Arizona Action, ACLU of Arizona, and AZ Attorneys for Criminal Justice signed in to oppose the proposal.
The efforts to augment penalties for these organized retail theft crimes continue the state’s already strong reputation on this front. Arizona has an Organized Retail Crime Task Force, which commenced under former Attorney General Mark Brnovich’s administration and is housed in the State Attorney General’s Office.

In December, her office announced that it had “seized thousands of cloned gift cards and other merchandise in partnership with the Arizona Retailers Association and with the help of law enforcement partners.” Mayes’ coalition also arrested eight people “as part of an alleged scheme to defraud retailers and consumers.” The first-term attorney general said, “The successful seizure of thousands of cloned cards and the arrest of several individuals reflects my office’s unwavering dedication to stopping organized retail theft across Arizona.”

The Maricopa County Attorney’s Office gives three tips to Arizonans to help them experience ‘safe shopping.’ Those include:
- Be patient with retailers. While it might take an extra minute to get an item (decongestants, for example) from behind a locked display, it’s worth it. Know you’re doing your part to keep prices low and keep crooks at bay.
- Never engage with thieves. If you’re suspicious, reach out to a store manager. Never confront a thief on your own.
- Keep your personal items locked up. If you carry a handbag, keep it closed and close to you. If you leave purchases in your car between shopping stops, make sure that vehicle is locked up tight.
