Arizona’s legislative leaders issued a statement of support for a federal action establishing a new level of parental rights to access their children’s medical records.
The Department of Health and Human Services (HHS) announced earlier this month further protections for parental rights in healthcare. HHS Secretary Robert F. Kennedy, Jr., cited an incident in which a Midwestern school allegedly ignored a religious exemption and vaccinated a child without parental consent.
That school remains under investigation by the HHS Office for Civil Rights (OCR) for potential violation of the Vaccines for Children Program (VFC), which requires providers of vaccines received federally to comply with state laws on religious and other exemptions.
In addition to Kennedy’s announcement, the Health Resources and Service Administration (HRSA) issued an advisement to its health center grant recipients of their required compliance with federal and state laws on parental rights. OCR also issued a letter to healthcare providers advising of their duty to provide parental access to children’s medical records.
“If a provider is standing between you and your child, HHS is going to step in,” said Kennedy in an announcement video.
House Majority Whip Julie Willoughby (R-LD13) published a statement expressing gratitude for the HHS action to assist parents in Arizona and nationwide.
“Arizona parents know this problem because they’ve lived it. Families have been locked out of online medical portals and forced to fight for access to records needed to schedule appointments, refill prescriptions, and communicate with doctors,” said Willoughby. “Parents should not need a lawyer or a lawsuit to see their child’s medical records. This problem was identified years ago. It’s time for the state to stand with parents.”
Republican lawmakers attempted to offer a similar remedy last year (House Bill 2183) and this year (House Bill 2126), but Governor Katie Hobbs vetoed both.
Both bills would have required health care entities to provide parents with access to any electronic portal and delivery platform of their child’s medical records, even in cases where the medical treatment given didn’t require parental consent.
Hobbs cited health, safety, and privacy rights as reasons for vetoing the bills.
“The measure as written could put the health and safety of vulnerable Arizonans at risk,” said Hobbs in her House Bill 2183 denial letter.
“Patient privacy is a longstanding tenet of American healthcare and this bill would create legal ambiguity for healthcare providers who have existing obligations to patient privacy,” said Hobbs in her House Bill 2126 denial letter.
The only community member to speak on the latest vetoed bill during its House committee hearing was a representative of the ACLU of Arizona and Planned Parenthood Advocates of Arizona, Marilyn Rodriguez with Creosote Partners.
The two activist organizations argued the existence of a distinct class of children — “mature minors” — which should be exempt from parental oversight in their medical care. Rodriguez claimed the bill would be “impacting mature minors’ confidentiality when accessing critical care.”
There is no statutory language that distinguishes “mature minors.” Rodriguez further argued that medical providers should decide whether a minor qualifies as a “mature minor,” not the legislature.
On behalf of Planned Parenthood Advocates of Arizona specifically, Rodriguez argued that minors should have the ability to access abortions without their parents knowing or consenting.
Again, during the Senate committee hearing on the bill, only a representative of Planned Parenthood was present to speak against the bill. Aven Kelley, a policy analyst with Planned Parenthood Advocates of Arizona, argued that minors should have autonomy and privacy when it comes to obtaining abortions.

A liberal Democrat is attempting to maintain her representation of a middle-of-the-road Phoenix-area legislative district for another term in office.
State Senator Eva Burch of Arizona Legislative District 9 is seeking to make a return to the chamber for the next term of office, running for reelection in the upcoming November General Election.
The incumbent Democrat proudly displays several endorsements from left-leaning organizations on her campaign website, including Planned Parenthood Advocates of Arizona, Save Our Schools Arizona, Moms Demand Action, Climate Cabinet PAC, Emily’s List, Human Rights Campaign in Arizona, Arizona List, End Citizens United, and Sierra Club.
Burch is staunchly in the camp of her open-borders colleagues in the legislature – as her voting record indicates. Last year (2023), Burch voted no on HCM 2007, which expressed the legislative desire that Congress enact the State Immigration Enforcement Act, which would allow states or political subdivisions of states, to enact, implement, and enforce criminal penalties that are prohibited in the criminal provisions of immigration laws.
This past legislative session (2024), Burch voted against SB 1231, which would have made it unlawful for a person who is an alien (unlawful immigrant) to enter Arizona from a foreign nation at any location other than a lawful port of entry. She also opposed SCR 1042, which proclaimed the Legislature’s support for the people and governor of the state of Texas in its efforts to secure our nation’s southern border. Additionally, she voted no on HB 2157, which would have prohibited a court from using a defendant’s deportation as the sole reason for early termination of probation or intensive probation.
More recently, Burch refused to support a legislative effort to refer a border security measure to the ballot in this November’s General Election – HCR 2060, voting against the bill when it was considered by her chamber. The proposal, if passed by voters in the fall, would empower local law enforcement to better secure their communities from the increasing calamities from the border crisis. A recent poll from Noble Predictive Insights showed that over fifty percent of Democrat respondents support the measure.
The Democrat lawmaker has also established a clear voting record for opposing bills that seek to lower taxes and reduce burdensome red tape for Arizona businesses. In 2023, she voted no on SCR 1018, which was a resolution restricting counties, cities, towns, municipal corporations, and political subdivisions from imposing a tax, rule, or law based on vehicle miles traveled. Burch also voted against SB 1156 that year, which would have increased the amount of the individual income tax subtraction for unreimbursed adoption expenses.
In the 2024 legislative session, Burch returned to her anti-small government ways, voting against SB 1056, which would have prohibited city councils or county board of supervisors from increasing an assessment, tax or fee without a two-thirds vote. Also, she voted no on SB 1153, which would have prohibited a proposed rule from becoming effective if the proposed rule is estimated to increase regulatory costs by more than $500,000 within five years.
Burch is also a soft-on-crime legislator. Over the past two years, she has opposed several bills that would strengthen Arizona statutes against crime and increase penalties for lawbreakers and those who seek to perpetrate harm on innocent men, women, and children. In 2024, she voted no on SB 1414, which would require a person who is convicted of a third or subsequent organized retail theft offense to be sentenced as a category two repetitive offender. She also voted against HB 2591, which would have prohibited a public power entity or public service corporation from entering into a contract with a person or company that uses forced labor or oppressive child labor.
Last legislative session, Burch voted no on SB 1583, which would have mandated that a level one sex offender who commits specified sexual offenses is required to register on the internet sex offender website if the offender was sentenced for a dangerous crime against children. Additionally, she opposed SB 1323, which would have made an employee or independent contractor of a public school who refers students to or uses any sexually explicit material in violation of existing statute criminally liable for a class 5 felony.
Arizona Legislative District 9 is one of the most competitive in the state, with a 2.6% vote spread between Democrats and Republicans over the past nine statewide elections, according to the Arizona Independent Redistricting Commission. Out of those nine contests, Democrats have won five compared to four for the Republicans.
Burch ran unopposed in the July 30 primary election. She is facing off against the winner of the Republican primary, Robert Scantlebury. In the 2022 General Election, Burch defeated Scantlebury by more than 3,000 votes to assume her seat.

A controversial event hosted by a Democrat State Representative at the Arizona Capitol has led to consequences from the Republican House Speaker.
Earlier this week, State Representative Lorena Austin and Planned Parenthood Advocates of Arizona hosted a Drag Story Hour in the Copper Basin Room in the House Basement.
That event was immediately met with condemnation from Republicans. Arizona House Speaker Ben Toma addressed the event on his “X” account, writing, “Democrat Rep. Lorena Austin deliberately misled House leadership to reserve a conference room to host a drag story hour with Planned Parenthood. Use of House facilities for radical activism to promote dangerously perverse ideology will not be tolerated while I am Speaker. As a result, I’ve ordered that Democrats have lost the privilege of accessing House meeting rooms until trust can be restored.”
Austin responded to the Speaker’s comments, saying, “This is the people’s House and that includes the LGBTQ+ community, whether my colleagues on the other side of the aisle like that or not. It is nothing short of ridiculous that I have been described as dishonest, deceitful and perverse and have been subjected to calls for punishment and expulsion. What is true is that I hosted a drag performer who read stories about LGBTQ+ history and inclusion. There were no minors present, but also no content that would offend a minor.”
The Democrat lawmaker added, “We were completely transparent when we reserved the room, and the content was not, or should not be, controversial. In total approximately 20 people attended (all adults) because the House is currently only conducting business on Wednesdays, and today was a Tuesday. It was educational and completely within the mission of our LGTBQ+ Caucus. I will never apologize for teaching people to be inclusive, to accept others as they are, and to stand up to hate and bigotry.”
Other Arizona state legislators weighed in on the event. Republican Representative Alexander Kolodin said, “The People’s House should be a safe place for the children of Arizona and I am outraged at this violation of trust. In addition to this punishment, also I call on leadership to bar Rep. Austin from accessing any part of the House aside from public areas and the floor.”
Democrat Representative Nancy Gutierrez stated, “Today’s event was wonderful and I was happy to attend. I appreciate Lorena Austin. It’s disgusting that this was used for political mudslinging.”

In a since-deleted article, “Three Women-Led Organizations That Helped Flip Arizona Blue,” principal actors behind several of the most powerful leftist dark money organizations in the state bragged about engineering Democratic voter turnout in the 2020 election.
Vianey Olivarria, then-communications director and current executive director for Chispa AZ, credited work done by her organization and others to turn out Democratic voters. Olivarria also served as a director of Activate 48, a coalition of Black, Indigenous, People of Color (BIPOC) organizations.
“Arizona turning blue is a victory a decade in the making and owed to the tireless work and dedication of Black, Brown, and Indigenous people who organize for justice and liberation,” stated Olivarria.

Chispa AZ is a 501(c)(4) project of the League of Conservation Voters (LCV), another 501(c)(4), and sponsored by Way to Win, a national donor network aimed at defeating Republican candidates. Way to Win served as the sponsor to Progress Arizona, formerly and once again led by Gov. Katie Hobbs’ ousted spokeswoman Josselyn Berry.
Per the IRS, a 501(c)(4) organization may engage in political campaigns on behalf of or in opposition to candidates so long as those activities aren’t the organization’s primary activity.
Discrepancies exist in various organizations’ tax returns disclosing contributions to Chispa AZ’s political arm, Chispa AZ PAC. Neither “Chispa AZ” or “Chispa AZ PAC” exist within the IRS database. Also, Chispa AZ has claimed the same EIN as LCV publicly; however, different organizations’ tax returns have cited multiple, nonexistent EINs for Chispa AZ.
In their 2018, 2019, and 2020 tax returns, LCV listed an EIN number for Chispa AZ PAC that yielded no results in the IRS Tax Exempt Organization database. In their 2019 tax return, LCV listed an organization called Fuerte Arts Movement for the Chispa AZ PAC’s address, and listed the same EIN number from 2018. They used the EIN again in their tax return.
In the 2019, 2020, and 2021 tax returns from the California-based Grove Action Fund, a different address and EIN number from that used by LCV were listed for Chispa AZ PAC. The listed address was the correct address for Chispa AZ; however, the EIN listed also doesn’t exist in the IRS database.
Planned Parenthood Advocates of Arizona’s 2020 tax return listed that same nonexistent EIN number as well, and offered the Fuerte Arts Movement address.
Tax returns from the Green Advocacy Project (2020) and the Wilderness Society Action Fund (2019) also listed the nonexistent EIN given by LCV, but listed the correct address.
Publicly collected data reflects that Chispa AZ PAC has managed at least around $8.5 million in contributions since 2017. Yet, Chispa AZ has claimed to have total revenues of nearly $26.9 million, net assets of over $18.4 million, and expenses of over $18.9 million.
Chispa AZ is also part of MiAZ, a coalition of nonprofits focused on turning out minority voters.
Other Chispa organizations exist in Colorado, Florida, Maryland, Nevada, and Texas.
Chispa AZ isn’t the only dark money entity lacking a clear IRS status to have an outsized impact for Democrats in recent elections. There’s also the two Arizona Asian American Native Hawaiian and Pacific Islander (AZ AANHPI) related organizations: AZ AANHPI for Equity and AZ AANHPI Advocates. Although AZ AANHPI wasn’t featured in the deleted 2020 article, their communications director was: Alexa Rio-Osaki. She spoke on behalf of a different dark money nonprofit also part of MiAZ: Our Voice, Our Vote.
“We’re doing what we can to ensure everyone’s represented,” said Rio-Osaki.
Rio-Osaki has her hands in multiple leftist dark money organizations: in addition to AZ AANHPI and Our Voice, Our Vote, Rio-Osaki served as the director of Progress Arizona.
Recently, AZ AANHPI for Equity has engaged in lawfare against non-party conservative organizations, demanding transparency of private documents while operating in the dark itself.
AANHPI for Equity and AZ AANHPI Advocates have independent websites, social media pages, and staff, yet the pair are presented as one entity in multiple locations (for example, on the AZ AANHPI for Equity “about us” page). Both were founded in July 2020 by Jennifer Chau, who has served as the director for AZ AANHPI for Equity, an unspecified nonprofit, and executive director for AZ AANHPI Advocates, a 501(c)(4) nonprofit, since their inception according to her LinkedIn page.
According to the IRS, AZ AANHPI Advocates had its federal tax exempt status automatically revoked in mid-May for not filing any tax forms in the entire three years of its existence (EIN:85-2344934). The IRS issued its revocation posting earlier this month. No IRS records exist for AZ AANHPI for Equity.
Yet, both organizations’ websites continue to solicit donations and market themselves as nonprofits. The Arizona Corporation Commission (ACC) awarded AZ AANHPI Advocates good standing for its status as a nonprofit in mid-July as well. No ACC records exist for AZ AANHPI for Equity.
Like Chispa AZ, AZ AANHPI has used EIN numbers of another organization in receipt of funds. In 2021, AZ AANHPI for Equity received $25,000 from Solidago Foundation and gave the EIN belonging to One Arizona, the 30-nonprofit coalition to which all five Arabella Advisors nonprofit arms issued funds. Also that year, AZ AANHPI made its name synonymous with “One Arizona” and used its EIN in its receipt of $35,000 in funding from Asian Americans Advancing Justice.
On its website, AZ AANHPI Advocates discloses that it receives funding from top leftist dark money organizations The Future We Need and Arizona Wins!. The listed address for The Future We Need is the same address for the Arizona Education Association and Progress Now Arizona (now Progress Arizona); yet, no such organization as “The Future We Need” exists per ACC, the IRS, the Federal Election Commission (FEC), or the secretary of state’s campaign finance databases. There does exist a similarly-named dark left political action committee (PAC) entity, “The Future We Want.”
In their entire three years of advocacy and fundraising, only AZ AANHPI Advocates had any campaign finance records filed within the state: just one receipt of $10,000 from Invest in Arizona in August 2021, for “signature gathering.” According to the secretary of state’s campaign finance database, AZ AANHPI has never filed any reports on their contributions or expenditures.
The deleted article was published by Supermajority News: a project of Supermajority and the Supermajority Education Fund, the latter a project of the Arabella Advisors’ New Venture Fund. Arabella Advisors is behind one of the biggest dark money funding networks in the nation; their shadowy dealings prompted the District of Columbia attorney general to issue subpoenas to the organization last month.
Along with their Arizona-based compatriots, Supermajority will also be working to turn out more Democratic voters in the upcoming 2024 election.
Last year, Supermajority reported turning out over 959,000 voters: nearly 116,200 in Arizona. The organization had over 8,000 active members in Arizona. Supermajority reported that they ensured the turnout of 30 percent of women ages 18 to 35 years old, specifically to ensure the re-election of Sen. Mark Kelly and election of Gov. Katie Hobbs. The organization disclosed that their approach consisted of contacting female Democrat voters that sporadically voted in presidential elections but hadn’t voted in midterm elections.
“At the state level, we were able to help elect and support progressive governors who would protect and expand women’s freedoms in their states,” stated Supermajority.
Supermajority took credit for Kelly’s re-election and Hobbs’ election, declaring that 92 percent of Kelly’s margin of victory was made up of their voters and that their 116,200-voter turnout far surpassed Hobbs’ 17,100-vote margin.
The organization also noted its plans for the upcoming 2024 election: contacting 432,300 female Arizona voters who didn’t vote last year, overcoming the projected 10,500-vote victory margin, and electing a Democratic senator to take independent Sen. Kyrsten Sinema’s seat. The organization also plans to target Georgia and North Carolina.
“We need a Democratic senator in AZ who will work alongside Sen. Mark Kelley [sic],” stated Supermajority.

The chairwoman of Planned Parenthood’s activist arm in Arizona bragged about her husband assaulting a supporter of former President Donald Trump.
In a midnight tweet over the weekend, Planned Parenthood Advocates of Arizona (PPAZ) Board of Directors Chairwoman Chris Love tweeted that her husband “body-checked” a man wearing a “Blacks for Trump” t-shirt while at a “Bans Off Our Bodies” pro-abortion rally in Phoenix on Saturday. PPAZ organized and hosted the rally as part of their national organization’s greater protest movement nationwide.
“My husband @MiQL got lost in the crowd and I had to send folks to find him. Instead of hanging in the tented area with the cool kids, he was organizing folks,” wrote Love. “He also body checked some dude in a “Blacks for Trump” shirt. Swoon!”
Love’s husband replied that he was just doing what was best for their movement.
“Doing what I can to support our collective efforts, Bew,” he wrote.
Others disparaged the man in the comments, mocking his hygiene and physical appearance.
This wasn’t the first time Love advocated for violence. In September, Love called for riots after the Supreme Court (SCOTUS) refused to intervene in Texas’ abortion ban. Elected Democratic officials approved of her messaging — both state legislators running for higher offices.
State Representatives Daniel Hernandez (D-Tucson) and Diego Rodriguez (D-Phoenix) retweeted Love’s urge to followers to “break some s**t” in response to Texas’ ban on abortions after a fetal heartbeat is detected.
Hernandez is running for Congress and Rodriguez is running for attorney general.
