Sen. Kavanagh’s Bill Would Require Schools To Use Students’ Real Names, Biological Pronouns

A bill requring schools to use students’ real names and biological pronouns is making its way through the Arizona legislature.

SB 1002, sponsored by Arizona Senator John Kavanagh (LD-3), would prohibit school districts, charter schools employees, or independent contractors from referring to any student by a pronoun differing from their biological sex or a name other than their legal name without parental consent. It also prevents a school district or charter school from requiring an employee or independent contractor to use a pronoun that differs from a person’s biological sex, if doing so is contrary to their convictions.

The bill has moved to the Arizona House of Representatives where it awaits approval by the caucuses and a final vote.

Explaining the bill in a video, Sen. Kavanagh said that his bill “has to do with school staff and teachers using a pronoun or a nickname for a student that is not aligned with that student’s biological sex. The bill says that no school personnel can call a student by such an inappropriate pronoun or nickname unless the parents consent. And in addition when the parents do consent, no school employee can be forced to call the person by the pronoun that does not align with their biological sex if it violates the employee’s religious or moral beliefs.”

He continued, “This is important because students that want to be called by a different name or pronoun than their biological sex, or so-called transgendered students, many of them have a condition called gender dysphoria, which causes a lot of anxiety, sometimes even suicidal thoughts. So, the parents may know about this and may have the child under psychiatric care and the child’s doctor may have told the parents do not entertain a different pronoun or name that’s different from the from the child’s real sex because it could harm the child. So, we certainly don’t want school personnel harming children and threatening their psychological well-being or driving them to suicide. So, we’re going to require parental permission because also it’s a matter of parents’ rights. Parents determine what’s good for their children, not a school staff member or a school teacher, however well-meaning they may be.”

As noted in the text of the bill, Arizona’s Parental Bill of Rights “reserves parental rights to a parent of a minor child without interference from the state, a political subdivision or other governmental entity or any other institution.” Among the rights enshrined in the laws A.R.S. §§ 1-601 and 1-602 are parental rights to direct their children’s “education, upbringing and moral or religious training,” and making healthcare decisions on their behalf.

Teachers Take Notes: Public Education Is Not About You

A retired educator once told me, “Parents don’t have rights, they have responsibilities.” Considering this viewpoint alongside the comment below, I can’t find any context in which these statements are appropriate.

In the same vein, former state Governor Terry McAuliffe (D-VA) said, “I don’t think parents should be telling schools what to teach.” Not to mention, the National School Board Association incited FBI Director Merrick Garland to declare war against parents.

In light of all the anti-parental rights sentiments infecting our education system, I declare:

Children are an inheritance, a reward, and a gift from God (Ps. 127:3). Therefore, they belong to their parents/guardians, not government employees. If your beliefs run contrary to this truth, then the following commentary was written with you in mind.

Two incidents lead to my discussion on parental rights in education. The first involves backlash I received after posting this flier in a parent group on social media:

Group members were appalled that I used the page to inform parents of their right to choose how their children are educated. One said, “I wonder what teachers would think?” Another member incoherently stated that teachers were being “used as political pons.” (I think she meant “pawns,” but we’ll blame public education for the error). The elementary shoving match in the comment section revealed that my primary opponent was, in fact, a teacher.

I was pitifully accused of being a “political operative” and called out for not focusing on strengthening relationships in the district. Never mind that I’m one of five people willing to attend board meetings. I’m also willing to find common ground with opposing leaders to improve academic success and student safety.

Still, I am not pro-teacher. I am not pro-administration. And I will never be pro-government. I advocate for families who rely on the public education system. I’m not primarily in the business of “strengthening relationships” with districts that condone violence, discriminate against Christians, force males and females to share private spaces, and socially transition students’ gender without parental knowledge or consent.

Our Parental Bill of Rights is one radical majority vote away from destruction. So, if giving parents options to circumvent government schools triggers you, then you’re part of the problem.

The second incident occurred on January 25, 2024, when teacher and Peoria Education Association (PEA) President, Trina Berg, requested public comments be moved to the end of the board meeting. Berg stated:

“My request is that we consider, and you have a discussion, and vote on moving public comments to the end of the board meeting. The reason why is because we have business we have to do. And I would appreciate it if we actually came in and did our business first … People still have the ability to speak on whatever they want, but it’s when business is done.”

Wouldn’t you know that public comments were relocated from position 5.1 to position 9.1 at the February 8 board meeting. Peoria Unified School District (PUSD) Board President Rebecca Proudfit — appointed by the financially compromised Maricopa County Superintendent Steve Watson — led the charge in compliance with Berg’s request.

During public comments, Proudfit and PUSD Board Member Melissa Ewing repeatedly caused interruptions, effectively violating one constituent’s First Amendment rights as well as Arizona Open Meeting Law § 38-431.01. The dynamic duo took offense to the speaker’s use of the word “evil” to describe transgender indoctrination in public schools. In the case of PUSD, the speaker’s assessment is entirely accurate.

When confronted about moving the comments, Proudfit claimed some teachers were uncomfortable with the atmosphere at PUSD board meetings. She also said the results of a survey — somehow received by educators but missed by parents — favored changing the meeting format. When pressed further about the timing of her decision, Proudfit said, “[Berg] did email me afterwards to say thank you … But I swear I wouldn’t do anything like that just because someone asked me to do it.”

Bear in mind, this is the same Trina Berg who staged an illegal sick out in defiance of the board’s decision to resume in-person learning after the 2020 winter break. District emails reveal that Berg and her co-conspirator, PEA Treasurer Jessica Batty (also a teacher), planned the union-backed catastrophe. At one point, Berg wrote, “[W]e are trying to show that this decision was especially dumb for retention.”

Berg’s shenanigans — which resulted in the closure of 13 schools — disrupted academic progress and left parents without childcare. So, why wasn’t this activist, posing as a teacher, fired?

The statement, “Teachers are not the primary stakeholders in public education,” is true contractually and financially. This is why teachers’ unions exist. Of course, educators typically have children, own property, and pay taxes in their district. But from a business standpoint, certified staff members do not hold revenue-generating positions — they are paid to provide a community service. For clarification: parents (and constituents) are patrons, students are beneficiaries, teachers are public servants.

Without parents and students, teachers wouldn’t have jobs.

When it comes to directing a child’s education, the law clearly identifies parents as the experts. And whether we consider parents “good” or “bad,” their rights are protected under the United States Constitution. The place of a teacher is to transfer knowledge, not propaganda, and foster an environment that’s conducive to learning, not excessive self-expression.

Communist dictator Vladimir Lenin — the man history deems responsible for the death of 10 million people — is credited with saying, “Give me just one generation of youth, and I’ll transform the whole world.” This is the ideological framework of someone who aims to incite rebellion and break family bonds. I implore leftist educators to reject radical approaches to instruction, abandon hypercritical theories, and, instead, work to form an alliance with parents/guardians.

Finally, I commend sensible and honorable educators who practice transparency, partner with families, and build strong support networks for their students. You are the teachers we can entrust with our youth. Now more than ever, your skills and compassion are needed to shape young minds for the betterment of society and secure the future of our nation.

Parents and guardians may be able to sue just about anybody that violates their rights under the Arizona Parents’ Bill of Rights, according to a bill that passed the Senate Judiciary Committee on Thursday. The bill, SB1049, also classifies parents’ rights violations as a class two misdemeanor and enables the attorney general or a county attorney to sue school districts or charter schools alleged to have violated parental rights. Courts may impose fines of up to $5,000 for each violation that occurred at the school. 

The bill passed 5-3. State Senator Kelly Townsend (R-Mesa) introduced the bill. During Thursday’s committee hearing, Townsend explained that the provisions of this bill were already law but lacked accountability.

The Arizona Parents’ Bill of Rights codifies the rights of Arizona parents to direct their child’s education, upbringing, moral or religious training, health care decisions, as well as the rights to access and review all of their child’s records, including medical records. 

State Senator Martín Quezada (D-Glendale) claimed that the “overwhelming majority” of parents’ frustrations could be resolved if they brought their issues to the educators for a conversation. Quezada said that this bill would only make parent-teacher relations more adversarial. 

“Nobody is out to violate parent’s rights. Nobody is out to harm parents and nobody is out to make an enemy of parents,” said Quezada. “I want to encourage people to leave their emotions aside, have conversations with your school district leaders and then hold them accountable in the way that you have been granted at the school board elections.”

Quezada’s claim doesn’t align with comments from others within his party across the country, such as the viral comments of Wisconsin State Representative Lee Snodgrass (D-Appleton), who tweeted that parents should either homeschool or pay for private schooling if they wanted to have a voice in their child’s education. Snodgrass deleted the post, issuing a follow-up simultaneously backpedaling with an apology and claiming that those upset by her remarks were misinterpreting her.

“I deleted my Tweet since it was lacking in nuance and easily misinterpreted. I wouldn’t want anyone to think that parents do not have a role in their child’s public education-I sure did. I encourage all parents to engage in voting for school board, join [parent-teacher organizations] PTO and meet with teachers,” wrote Snodgrass. “To clarify, my point is we should be fully funding our public schools and that diverting funds away from our public schools only makes it harder for parents to have the relationships we deserve with our kids’ teachers and their schools. Of course parents need to have a say in their kids’ education and their classrooms! I’m a parent, and I have a say, as should every parent. I shouldn’t have been cavalier or glib—that wasn’t my intention, and I apologize. Carry on!”

State Senator Wendy Rogers (R-Flagstaff) rebutted Quezada’s remarks, reading a text she received from a constituent while the committee reviewed the bill, describing how the Flagstaff Unified School District (FUSD) governing board refused to work alongside parents. 

One mother who spoke in favor of the bill reminded the committee that hundreds of Arizona educators signed a pledge last year to continue teaching what they desired, irrespective of parental consent or the law, in response to states implementing bans on Critical Race Theory. As of press time, there were over 200 Arizona educators that signed the pledge. 

About 8,000 educators nationwide have signed that pledge. There are about 3.2 million public school teachers and 500,000 private school teachers in the country.

At least one Arizona educator didn’t identify their city or town: Andrea Barrera.

Some school districts and politicians contend that Critical Race Theory isn’t taught in schools — but that’s not what educators have to say. One of the educators who signed the pledge, School District of Philadelphia Special Education Compliance Manager (SPECM) Aisha Eubanks, explained that educators use alternative names for Critical Race Theory when teaching it. Eubanks works at Martin Luther King Jr. High School in Philadelphia, Pennsylvania. 

“It is not Critical Race Theory in K-12 it is called being Culturally Responsive and teaching truth-based history, which is based on systemic racism,” wrote Eubanks. “I plan to continue doing just that.”

In addition to Culturally Responsive Education (CRE), sometimes called Culturally Responsive Instruction (CRI), other names for Critical Race Theory include social-emotional learning (SEL) and comprehensive equity plans.
