Reps. Andy Biggs (R-05) and Eli Crane (R-02), along with other House Republicans, failed to convince their colleagues to impeach Department of Homeland Security (DHS) Secretary Alejandro Mayorkas over his handling of the border crisis.
Biggs asserted that Mayorkas was in violation of the separation of powers, citing the secretary’s inaction on the removal of over one million illegal immigrants eligible for deportation, and neglect of Title 8.
“That has resulted in great injury to our communities, and that is why he must be impeached, because he falls within the definition of one of the Founders, James Iredell said, and he’s right on the money,” said Biggs.
The great James Iredell — one of our first Supreme Court Justices — said that “the power of impeachment is given by this Constitution to bring great offenders to punishment.”

Despite the number of illegal immigrant crossings and drug trafficking reaching unprecedented record highs under President Joe Biden, Mayorkas has maintained that the border crisis originated from decades of congressional inaction rather than the policy of this current administration.
Mayorkas and other Democratic leaders support the $118 billion Senate bill described as a border bill, though a majority of the funding goes to Ukraine and other countries.

Lawmakers opposed to the bill pointed out its increased leniency for illegal immigration, such as a provision allowing those who either make it over 100 miles or remain longer than 14 days in the country to avoid deportation. The bill also would create a new, nonimmigrant visa subcategory enabling noncitizens to visit family members, as well as removing illegal immigrants from countries other than Mexico or Canada out of total encounters.
The bill also included another $60 billion for Ukraine, while providing just over $20 billion for the border, over $14 billion for Israel, $10 billion in humanitarian aid, over $6 billion for a variety of over projects, nearly $5 billion for the Indo-Pacific, and over $2 billion for the Red Sea conflict.
President Joe Biden claimed the bill wasn’t perfect: not because it didn’t close the border more for illegal immigration, but because it didn’t go far enough to grant citizenship for those illegal immigrants within the country.

Some lawmakers have argued that Mayorkas would ignore limited enforcement measures passed.
During Tuesday’s debate on Mayorkas’ impeachment, Crane accused the secretary of that very inaction on immigration enforcement.
“How many Americans have to die of fentanyl, MS-13 gang members, having their kids raped and murdered?” asked Crane. “It’s high time that [Mayorkas] be held accountable for his complete dereliction of duty at our southern border.”

Rep. Greg Stanton (D-04), in a joint statement with the New Democrat Coalition (NDC), called the impeachment a “sham,” and blamed Republicans for the state of the border.
The House GOP has relentlessly pursued a sham impeachment of @SecMayorkas, but they just rejected a strong, bipartisan border security bill without even reading it.
It’s shameful, and it’s Arizona communities that are paying the price.
Three Republicans — Reps. Ken Buck (CO), Mike Gallagher (WI), and Tom McClintock (CA) — joined Democrats in defeating the impeachment measure, 214-216.
However, House GOP leadership say that Tuesday’s vote wouldn’t be the last attempt at impeaching Mayorkas. A spokesman for House Speaker Mike Johnson (LA) said he plans to whip more votes.

Reps. Andy Biggs (R-AZ-05), Paul Gosar (R-AZ-09), and Raúl Grijalva (D-AZ-07) were three out of less than 30 congressmen to push back against President Joe Biden’s bombing of Yemen.
Last week, the three men signed onto a bipartisan letter with 27 other members of Congress to declare that the military strikes were unauthorized, therefore unconstitutional, and that Biden required the consent of Congress to further engage.
“Article One of the Constitution is clear: Congress has the sole power to declare war and authorize U.S. military action,” stated the letter.
The congressmen argued that Biden only holds the authority to introduce U.S. forces into hostilities either after a declaration of war by Congress, after specific statutory authorization from Congress, or in a national emergency when the U.S. is under imminent attack.
Biden ordered the strikes earlier this month in response to Yemen-based Houthi militant attacks on U.S. military forces dating back to November. Biden’s letter to Congress announcing the strikes alleged that he had authority under the War Powers Resolution (WPR) of 1973.
Immediately following Biden’s letter to Congress, Biggs condemned the move as unconstitutional.
“[Biden] can’t unilaterally pull us into another war,” said Biggs. “Why does he want so many wars?”
Biden’s airstrikes in Yemen blatantly violate Article 1 of our Constitution.
Similarly, the congressmen contended in their letter that Biden proceeded under a selective reading of the WPR.
“The WPR of 1973 does not give blanket authority for a President to unilaterally involve U.S. military forces in a conflict if a President simply notifies Congress within 48 hours. The 48-hour reporting requirement only applies to a situation in which a President must act due to an attack or imminent attack against the United States,” read the letter.
However, the letter didn’t express any intent on applying punitive measures for the executive overreach. Rather, the letter concluded with a request for Biden to heed to their authority under the Constitution, with an offer to “debate” any war-making request by the administration.
The other members of Congress to sign onto the letter were Democratic Reps. Ro Khanna, Val Hoyle, Pramila Jayapal, Cori Bush, Jonathan Jackson, Summer Lee, Rashida Tlaib, Greg Casa, Ilhan Omar, James McGovern, Jesus “Chuy” Garcia, Eleanor Holmes Norton, Ayanna Presley, Nydia Velazquez, Alexandria Ocasio-Cortez, Delia Ramirez, Barbara Lee, Jamaal Bowman; and Republican Reps. Warren Davidson, Thomas Massie, Nancy Mace, Anna Paulina Luna, Marjorie Taylor Greene, and Harriet Hageman.
In another statement on Tuesday following the deaths of three troops in Jordan, Gosar again declared Biden lacked the authority to bring the U.S. into a foreign conflict.
“Biden does not have the authority to take us into war with Iran without Congressional approval,” said Gosar.

Gosar further declared that Biden’s foreign policy was to blame for the three deaths.
“Biden bears full responsibility [for] the drone attack on our troops by recklessly reopening nuclear arms negotiations [with] Iran [and] giving them $6 billion [to] fund its military, refusing [to] enforce the Trump-imposed Iranian oil sanctions which has allowed Iran [to] rake in billions of profits,” said Gosar. “Biden also reversed the Trump-imposed freeze on millions of dollars that were diverted [to] Iran-sponsored terrorist activities.”

Human smugglers assaulted a Border Patrol agent with rocks while he was arresting several illegal immigrants near San Luis, Arizona, earlier this week, Border Patrol reported. Rep. Andy Biggs, R-Ariz., called out the “lawlessness” of the incident.
“This lawlessness must come to an immediate halt,” Biggs said on Twitter.

Chief Patrol Agent Sean McGoffin said human smugglers threw rocks at the Border Patrol Agent hitting him in the head early Tuesday morning, leading to lacerations across the eye. An investigation is underway to bring those responsible to justice, according to Border Patrol.
“Wishing this agent a speedy recovery,” Biggs continued. “Many folks streaming across our border right now are armed and dangerous.”
McGoffin of the Yuma Sector Border Patrol said individuals were making an illegal entry into the area of the assault and the smugglers who were on the Mexican side of the border began throwing rocks.
The agent was taken to the hospital and is now on the road to recovery, according to McGoffin.
“The agent is doing okay,” McGoffin said. “We’re thankful for him being okay, but he did have to go and receive medical treatment. He’s currently not back to work yet, but we anticipate he will be in the near future, we’re just so thankful that he’s safe.”
McGoffin said that though overall assaults have been down over the previous year, every assault is serious and could be fatal.

A bill proposed by Rep. Andy Biggs, R-Ariz., would require abortion providers to show pregnant women their unborn baby on an ultrasound before proceeding with the abortion.
The Ultrasound Informed Consent Act provides pregnant women an opportunity to review ultrasound imaging before ending their baby’s life.
“The Biden Administration’s heinous pro-abortion policies continue to incentivize women to end the lives of innocent, unborn American children. My legislation provides pregnant women a safe and intimate opportunity to rethink their abortion,” Biggs said in a news release. “This subtle but important process change can potentially save millions of unborn lives.”
Under the proposed legislation, the abortion provider must provide an ultrasound, explain what it depicts, display the images to the woman, and provide a complete medical description of the unborn child’s dimensions, cardiac activity, external members, and organs.
The woman is allowed to turn her eyes away without penalty if she does not want to see the image. The bill does not apply to medical emergencies.
Studies show that about 80% of abortion-minded women choose life after viewing their ultrasound.
The bill came during the week of the 51st March for Life, when tens of thousands of people voiced their support for the right to life in Washington, D.C. The legislation has received support from the National Pro-Life Alliance.
“We congratulate Congressman Andy Biggs for taking the leadership on this vital legislation that would ensure that each woman has the right to know the truth about her unborn child,” said Martin Fox, president of the National Pro-Life Alliance. “Congressman Biggs’ Ultrasound Informed Consent Act guarantees that mothers know exactly what an abortion is ending: not just ’tissue’ or a ‘clump of cells’ but the life of her unborn baby.”
Bill co-sponsors include Republican representatives Jeff Duncan of South Carolina, Andy Harris of Maryland, Matthew Rosendale Sr. of Montana, Alex Mooney of West Virginia, Mary Miller of Illinois, Dan Crenshaw of Texas, and Eric Burlison of Missouri.
“Defending the right to life remains one of my top priorities in Congress,” Biggs said.

Rep. Andy Biggs (R-AZ-05) said that the January 6, 2021 footage in its entirety was “embarrassing” for mainstream media and the Democrat-led January 6 Committee.
Key discoveries in the newly-released footage provided substantiation to claims that police officers didn’t treat activists who intruded the Capitol as criminals on that fateful day. In numerous videos, Capitol Police Officers were seen giving handshakes and fist bumps to the intruders, uncuffing intruders, leading intruders through the building, and holding doors open for the intruders.
“Quite embarrassing for the MSM and J6 Committee,” said Biggs. “How anyone could compare this day to 9/11 or the Attack on Pearl Harbor is beyond me. Shameful.”

Comparisons of the January 6 rioting to major terrorist attacks has been common rhetoric among Democratic leaders.
In Biden’s first address to a joint session of Congress in April 2021, he declared that January’s incident was the worst attack since the Civil War.
“[I] inherited a nation — we all did — that was in crisis,” said Biden. “The worst attack on our democracy since the Civil War.”
Vice President Kamala Harris compared January 6 to 9/11 and Pearl Harbor during her speech last January commemorating the Capitol riot. Harris accused the January 6 activists of attempted murder in addition to insurrection.
“Certain dates echo throughout history, including dates that instantly remind all who have lived through them where they were and what they were doing when our democracy came under assault, dates that occupy not only a place on our calendars but a place in our collective memory,” said Harris. “What the extremists who roamed these halls targeted was not only the lives of those elected leaders, what they sought to degrade and destroy was not only a building, hallowed as it is, what they were assaulting were the institutions, the values, the ideals that generations of Americans have marched, picketed, and shed blood to establish and defend.”
That same day, Sen. Majority Leader Chuck Schumer (D-NY) also declared in a Senate floor speech that January 6 was comparable to Pearl Harbor and 9/11.
“We did not look away after the attack on Pearl Harbor. We did not look away after the attacks on 9/11,” said Schumer. “They may have been from foreign powers, but we still, just because it was Americans who did this, we cannot look away after the attack of January 6th.”
Last December, Press Secretary Karine Jean-Pierre issued similar remarks in defense of the January 6 Committee actions against Republican leaders, including Biggs.
“What we saw on January 6 was the worst attack on democracy since the Civil War,” said Jean-Pierre.

Part of what Jean-Pierre defended was the ethics probe into Biggs after he refused to comply with their subpoena.
