“The Department of Education shall terminate on December 31, 2023.” If you’ve read this far, you have completed HR899, introduced by Rep. Thomas Massie.
Abolishing the DOE isn’t a new idea. The department was created in 1979 by the Carter administration, fulfilling a campaign promise to the NEA, the teachers’ union, which in turn gave him their first ever presidential endorsement.
But skepticism over the department was present even at its inception. The bill passed by just four votes in a heavily Democratic House. Ronald Reagan, always concerned about over-centralized power, immediately campaigned to unwind it. Several Republican education leaders since have endorsed its elimination.
1979 hardly marked the beginning of a glorious new age for American education. Per pupil spending on education since then has more than tripled, inflation adjusted, but there is little to show for it.
Achievement scores have been stagnant and still lag many of our peer nations in the developed world. The racial gap in academic achievement persists in spite of the department’s high-profile efforts. The bureaucrats and interest groups receiving the funding are fine with it, of course, but for the rest of us, it hasn’t accomplished much.
The DOE isn’t really designed to make an impact. It doesn’t establish or approve a curriculum. It doesn’t operate one school or educate one student. It doesn’t administer or create tests. It doesn’t establish standards for colleges and universities. We wouldn’t want it to do any of those things, but it naturally raises the question: is the DOE needed at all?
The department has over 4,000 employees who do research and write policy papers on education that are read mostly by each other. They administer the beleaguered student loan program and federal aid for education. Over 500 workers toil in the Office of Civil Rights.
Senator Joni Ernst notes that 94% of the DOE‘s staff were deemed nonessential during a government shut down. As one official summarized, “it really is just a grant making entity with a huge bureaucracy.”
Americans rightly respect the importance of education and are apprehensive about failing to support anything labeled “education.” The department doesn’t stir public animosity like Justice, Homeland Security, and other cabinet departments often do.
J. Luke Wood, president of Sacramento State University and a former professor of education at San Diego State University, asserts the attempt to eliminate the DOE has nothing to do with federalism or any legitimate substantive argument. No, the real motivation is…racism!
Yes, those darn Republicans are at it again, advancing unrelated pseudo-arguments to provide cover for their race hatred. They are engaging in “racelighting” i.e., racial gaslighting which is an “act of psychological manipulation where people of color receive racial messages which distort the realities and lead them to second-guess themselves.”
Opponents claim HR899 is just an attempt to shape curricula that teach a “fairy tale” history, omitting the ills of slavery as well as ignoring Jim Crow, miscegenation, and redlining. Furthermore, they say it is purposely intended to strip civil rights protections for minority students.
Yikes! Just being around Republicans, you would never imagine that they are such over-the-top bigots. Then again, maybe it is Professor Wood and his ilk who are the racial dividers, seeing racism as the explanation for nearly everything.
If they are so concerned about the civil rights of minority students, why not embrace school choice and charter schools? These reforms have demonstrated their capability to actually improve educational outcomes and lift children out of poverty.
Some see HR899 as a quixotic endeavor. Maybe it is. Bureaucracies, whatever their failings, are skilled, aggressive, and usually successful at defending themselves.
But there is one overarching reason why the DOE needs to go. We can’t afford it.
America is in big trouble financially. We have normalized intergenerational fiscal theft to finance so much wasteful, politically motivated spending that we are now $32 trillion underwater. Interest on the debt is crowding out other priorities and $50 trillion is in view. Still the Biden administration, with an election looming, continues to propose yet more new spending programs.
Instead, we should be desperately seeking out nonessential expenditures that could be cut without any significant harm. The Department of Education is an ideal place to start.

On Monday, the Biden administration announced that Mohave Valley Elementary School District received over $586,000 for mental health program funding. The funds will pay for up to 22 new positions.
This latest round of funding was part of over $95 million issued across 35 states. In total, the Department of Education (ED) has awarded $286 million to 264 grantees in 48 states for mental health programs.
The funding originated from the Bipartisan Safer Communities Act (BSCA) enacted last June as part of the Biden administration’s National Mental Health Strategy. The BSCA’s primary initial purpose was to reduce gun violence in schools and surrounding communities.
Last September, the Biden administration issued nearly $1 billion through BSCA for more mental health program funding. Arizona received an allocation of over $20.8 million.
The Biden administration also issued $122 billion in American Rescue Plan Act (ARPA) funding to hire more school psychologists, counselors, and mental health professionals in K-12 schools. ED reported that, compared to pre-pandemic staffing numbers, school social workers have increased by 48 percent, school counselors have increased by 10 percent, school nurses have increased 42 percent, and school psychologists have increased 10 percent.
The Biden administration earmarked these funds for “high-need” local education agencies (LEAs), such as those with high rates of poverty as well as high student-to-mental health professional ratio, high rates of chronic absenteeism, exclusionary discipline (e.g. suspension, expulsion, seclusion, or restraint), referrals to the juvenile justice system, bullying or harassment, community and school violence, or substance use. High-need could also include those who experienced a natural or man-made disaster, or a traumatic event.
Buried within the ED guidance on usage of these funds, the agency encouraged a total overhaul of traditional disciplinary practices.
“Rather than focusing on changing behavior through punishment or removal from the learning environment, school leaders should consider adopting practices that will help educators support students by identifying the root cause of the behavior and developing effective strategies to eliminate or mitigate it,” stated ED. “Building a school culture of curiosity and growth mindset that prioritizes solution-based thinking may encourage pro-social behavior.”
Some of the punishment alternatives included “art program, mindfulness, and body movement activities.” ED also suggested that non-violent behavior be met with conflict resolution training and programs rather than exclusionary discipline.
The Biden administration left it up to each state’s education authority to determine what constituted “high need.” However, the administration noted that the state may require LEAs to describe how they promote meaningful cultural and linguistic engagement. ED further noted that school-based violence prevention programs must be “culturally affirming” in addition to supporting positive relationships, resilience, self-control, empathy, and persistence.
“SEAs may also require LEAs to describe their process for meaningful culturally and linguistically centered student, parent, family, educator, staff, and community engagement and evidence of how that engagement informed their school safety and climate plans, related policies, and strategies,” stated ED.
The ED noted that the permitted use of funds wasn’t limited to improving students’ mental health. ED noted that permitted fund usage included educator and school staff surveys, convenings, and educator outreach efforts.
ED also encouraged funds to be used to prevent and address identity-based bullying. The Biden administration now recognizes sexual orientation and gender identity as protected classes under anti-discrimination law.

On Wednesday, the state’s teachers union protested against the Arizona Department of Education’s newly-launched hotline for parents to report inappropriate class materials.
The Arizona Education Association (AEA) had educators and activists march around the state capitol and ADE building, holding signs and chanting. Some signs read, “Stand with Educators,” and “Stop the Attacks.”
AEA also issued a letter on Wednesday to ADE Superintendent Tom Horne. The activists delivered a copy of the letter to the ADE office following a short speech outside the building. The AEA characterized the hotline as another political game.
The body of the letter is reproduced below:
Consider this an open invitation to visit Arizona schools and meet with educators. Come see for yourself the hard work, expertise and passion that go into each day. The constant attacks, along with low wages and underfunded classrooms, are causing far too many of our colleagues to leave the profession and the state. Our students and our schools deserve better. Take down the ‘hotline.’ Stop the attacks and stand with us.
Horne told Fox News on Wednesday that he was aware of the hotline’s unpopularity with certain groups, and criticized the teachers that participated in the protest. The superintendent implied that those teachers protesting were opposed to transparency and accountability.
“I served 24 years on a school board, and our rule was anybody could come in and watch the teaching, and the teachers never complained because they were proud of what they were doing, so those who are protesting, maybe they are not so proud of what they’re doing,” said Horne.
ADE launched the hotline last Tuesday. The department clarified in a corresponding press release what qualified as inappropriate school lessons: those focused on race or ethnicity, rather than individuals or merit; promoting gender ideology; social-emotional learning (SEL); or sexual content. ADE cited our reporting as an example of those committed to teaching inappropriate materials, in which AZ Free News documented over 200 educators who signed onto a statement proclaiming that they would teach outlawed materials like Critical Race Theory (CRT) even if banned.
ADE stated that the hotline represented their administration’s commitment to transparency and empowering parents.
Under former Superintendent Kathy Hoffman, ADE’s commitment to transparency looked slightly different. As AZ Free News reported in January, the former administration neglected the state’s school choice program: it had less than one-third of the staff designed to run the program and nearly 171,600 unfulfilled expense requests, despite receiving millions in additional funding for hiring and operation expansions.
AEA President Marisol Garcia claimed that the hotline would invite harassment of educators, and allow for accusations to be vulnerable to open records requests.
“Inviting the harassment of educators, without due process at their local level, with the ability of these ‘accusations’ to be FOIA’d?” asked Garcia. “As if nothing bad is going to happen here?”
Teachers union members and supporters filled the Capitol following the march.

On Wednesday, the Department of Education (ED) announced the distribution of over $20.8 million to increase mental health oversight in Arizona schools.
The funds may be applied to a variety of mental, social, and emotional initiatives within schools. This includes school counseling, mentorships, and bullying and harassment prevention.
During a press call on Wednesday, the ED featured insight from Dr. Marty Pollio, the Jefferson County Public Schools superintendent in Louisville, Kentucky. Pollio said that the SCG funds allowed for three means of school improvement:
- Identify students in need and in crisis who need mental health support like counseling;
- Reduce the counselor-to-student ratio;
- Train teachers on how to identify troubled students and support school personnel.
Pollio suggested that mental health professionals, such as board-certified behavioral analysts, should be deployed to classrooms to identify problematic students.
“Educators have to do more than ever,” said Pollio.
AZ Free News asked the Biden administration whether they would be providing guidelines for behavior analysis enabled by SCG funds, such as what students would be deemed problematic as Pollio suggested. The ED said they weren’t providing guidelines. Rather, the ED said that level of management would be up to the states and districts.
“[The SCG] allows states and districts to tailor their funds to each district and school,” said one of the officials.
The funds come from the Strong Connections Grant (SCG) within the Bipartisan Safer Communities Act (BSCA). Nationwide, grant funds totaled over $971 million.
ED Secretary Miguel Cardona asserted that teachers have been handling student behaviors on limited funding and resources, and that students behaved better with reduced disciplinary action and increased promotion of positive behavior. Cardona noted that in all, investments to improve mental health in schools through SCG total $1 billion.
“We must broaden our focus beyond physically safe learning environments,” said Cardona. “If we’re serious about equity and opportunity, we must expand our definitions of learning and growth to include mental and emotional health.”
MORE ON THE STRONG CONNECTIONS GRANT
President Joe Biden’s special assistant for education policy, Maureen Tracey-Mooney, said that the SCG funds are designed for “high impact strategies” that would ultimately impact home life, such as counseling, tutoring, mentoring, and summer learning.
Earlier this month, Cardona sent a letter to the Arizona Department of Education (ADE) notifying them of this recent investment. Cardona’s letter provides educators with suggestions and guidelines on how to implement the SCG funding.
The ADE will decide which school districts will receive the SCG funds and oversee their expenditure. However, the ED retains the authority to audit and investigate schools’ use of the SCG funds.
