In a move to protect Arizona’s land, critical infrastructure, and national security, Senate Republicans have passed legislation tightening restrictions on foreign adversaries seeking to acquire interests in state real property or install surveillance-related equipment. SB 1683, sponsored by Majority Whip Frank Carroll (R-LD28), advanced through the Senate on a narrow 18-12 vote last week.
The bill heads to the House for further consideration.
The bill amends ARS § 33-443 to close loopholes that could allow foreign adversary nations or their agents to indirectly control Arizona land or infrastructure through complex ownership structures.
“National security doesn’t stop at our borders; it includes our networks, infrastructure, land, and the systems Arizonans rely on every day,” stated Carroll. “Hostile threats are growing more advanced, more aggressive, and more dangerous – ignoring that reality would be irresponsible.”
Key provisions of SB 1683 include:
- Lowering the threshold for a “substantial interest” in real property from 30% to 15%, calculated as if any contingent interests held by foreign adversaries are exercised, to prevent hidden ownership stakes.
- Prohibiting foreign adversary nations or agents from directly or indirectly purchasing, owning, leasing, acquiring concessions, or obtaining substantial interests in Arizona real property. This covers transactions granting physical access, exclusion rights, development capabilities, or the ability to attach fixed structures.
- Banning the installation, maintenance, data access, or operation of equipment such as uncrewed/autonomous systems, antennas, communications systems, surveillance devices, or high-sensitivity sensors on Arizona property—whether permanent, temporary, physical, or embedded.
- Prohibiting evasion tactics, including the use of shell companies, intermediaries, partnerships, trusts, or restricting to obscure beneficial ownership or maintain functional control.
- Requiring public utilities, telecommunications providers, critical infrastructure owners, and government agencies to report suspected leases, licenses, or colocation agreements that may allow prohibited equipment installation to the Attorney General and Corporation Commission.
- Classifying violations involving prohibited equipment as a Class 5 felony for foreign adversary agents.
- Aligning with federal processes, including violations of Committee on Foreign Investment in the United States mitigation agreements or presidential divestment orders, and allowing the Attorney General to seek injunctions, forfeiture, removal of devices at the violator’s expense, or automatic stays during federal reviews.
- Applying to new transactions and renewals/extensions/modifications of existing interests on or after the effective date, with emergency provisions to preserve public peace, health, and safety.
“This legislation strategically ensures Arizona is prepared, not reactive, in protecting critical infrastructure. Protecting public safety is a core function of government, and that means addressing security gaps,” added Carroll. “Arizona farmland, properties near military bases, airports, utilities, and critical infrastructure must not be used for foreign espionage or as leverage by hostile regimes. It’s a priority for me to put the safety of Arizona and its citizens above all else.”

15 months. That is how much time we have left until Arizona can elect a new governor, and it couldn’t come soon enough.
Since taking office in 2023, Katie Hobbs has been a complete disaster. The heights of her corruption have certainly been well documented. From her illegal use of public resources to solicit money for her inauguration, to an alleged pay-to-play scheme between Hobbs and an Arizona group home that donated to her inauguration, to shelling out $700,000 to a company owned by the brother of the now-former Office of Tourism Director to create a new state logo, Hobbs has proven that the people of Arizona are her lowest priority. And there are no signs that will change any time soon.
In the latest reveal of her efforts to turn her office into a jobs program for her political friends, it was discovered that Hobbs handed out nearly $600,000 in taxpayer money to a former Democrat politician and her assistant for two newly created jobs. These just add to the long line of other phony baloney jobs Hobbs has created so that her buddies can get paid six-figure salaries to sit around and do nothing on your dime. In fact, just last year, she added six new jobs in the newly created Office of Resiliency (whatever that is), four new employees in the Office of Tribal Relations, and three new in-house attorneys, to name a few. All total, Hobbs has increased executive employment costs by over 50%!
With all these new government jobs, you would think Arizona must be leading the way in the nation for job creation, but no. It’s just the opposite…

When the history of America is written, it will certainly have a section on our global rivalry with our first existential threat of the twenty-first century: The Chinese Communist Party (CCP). In that narrative, we’ll be reminded of the leadership of President Donald J. Trump who has taken the fight to communists who wish to see our nation collapse. When I am the next governor of Arizona, I’ll follow the President’s lead by working with the State Legislature to get a bill prohibiting the ownership of real property in Arizona by the Chinese government passed and signed into law within the first 60 days of my administration.
Unfortunately, right now our country is stuck with too many weak politicians like Arizona Governor Katie Hobbs, who has failed to stand up to China and protect Arizonans.
Through subversion, cutouts, and espionage, China has attempted to infiltrate the United States and develop surveillance capabilities within our own borders. The CCP’s most recently emergent strategy is to purchase land in the United States, preferably near sensitive military sites and energy infrastructure, to garner intelligence.
At the federal level, I cosponsored the No American Land for Communist China Act to address this problem. Many states are also taking action to proscribe purchases to prevent potential probing by the Chinese government. Arizona’s Legislature recently passed, with exclusively Republican votes, Senate Bill 1109, which safeguarded the United States.
The bill makes clear that the purpose is to protect critical infrastructure, and to, “…protect this state from global security threats and halt or reverse the influence operation of the Chinese Communist Party that poses a risk to the national security of the United States.”
As you might expect, you cannot find a Democrat who supported this national security bill. Nor would you be surprised to see that Governor Hobbs vetoed the bill.
Why would Governor Hobbs permit our nation’s enemy, and make no mistake that China’s hegemonic ambition defines it as more than an economic competitor, to purchase lands in our state?
Arizona has one of the largest nuclear power plants in the United States. We have multiple dams that ensure Arizona’s water needs are met, as well as military training facilities used by our services and allies. Our state is home to a huge aerospace and defense complex, with military bases housing advanced military machinery and personnel. Our state’s high-tech industry has grown businesses and fostered talent from across the state and country to become a global giant.
Protecting these assets takes strong leadership, but Governor Hobbs has shown to be weak and indecisive when it comes to protecting Arizonans.
She has failed to recognize the CCP threat that has come across our border, which includes Chinese students attending universities that have been arrested for spying on U.S. military bases. The Chinese military has made scale mock-ups of U.S. aircraft carriers ostensibly to train on how to defeat them. And Chinese bellicosity over Taiwan included a demand that the Chinese military prepare to go to war.
And we’ll never forget the most pronounced example of Chinese surveillance in America when a spy balloon was permitted to float over U.S. airspace, oddly taking a course that flew directly over several sensitive United States military assets before being destroyed over the Atlantic Ocean.
Joe Biden failed to act and keep our nation secure, just like his good friend Governor Katie Hobbs has failed to protect the best interests of Arizonans.
The comparisons between Hobbs and Biden are too similar to ignore: weak, timid, and unable to take action that puts our citizens ahead of foreign threats.
Arizona needs a strong, decisive leader who knows what it takes to keep our state safe. It’s clear now that Katie Hobbs would rather protect the CCP than Arizonans.
