Arizona Supreme Court Clears Three GOP Legislators for Election

On Monday, the Arizona Supreme Court dismissed claims of insurrection against State Representative Mark Finchem (R-Oro Valley) and Congressmen Paul Gosar (R-AZ-04) and Andy Biggs (R-AZ-05), ruling them valid candidates for the upcoming election. 

A progressive nonprofit, Free Speech for People, alleged that the three legislators weren’t qualified because they committed insurrection through their actions and speech on January 6, a purported violation of the U.S. Constitution’s “Disqualification Clause”: Section 3 of the Fourteenth Amendment. 

In response to the ruling, Gosar asserted that free speech prevailed against the Democrats. 

Finchem declared that the GOP continued its winning streak with this latest ruling. 

The court agreed with the Maricopa County Superior Court’s ruling from last month. Judge Christopher Coury didn’t entertain whether or not the three lawmakers engaged in insurrection. Rather, the courts agreed that the plaintiffs lacked the ability to enforce it. The Arizona Supreme Court agreed with the superior court’s assessment that the U.S. House of Representatives has the sole authority to determine a candidate’s fitness to serve in Congress. 

“1) Congress has not created a civil practice right of action to enforce the Disqualification Clause, and the criminal statute prohibiting rebellion or insurrection, 18 U.S.C. § 2382, does not authorize the challenge by a private citizen; 2) A.R.S. § 16-351 does not provide a private right of action to argue a candidate is proscribed by law from holding office; 3) it is unnecessary to decide if the Amnesty Act of 1872 is applicable because no private right of action exists under the United States Constitution or Arizona law; 4) the Constitution reserves the determination of the qualifications of members of Congress exclusively to the U.S. House of Representatives; 5) the doctrine of laches is not applicable at this time; 6) Plaintiffs do not satisfy the legal standards for injunctive relief; and 7) there is no need for an advisory trial. Plaintiffs timely appealed.”

The nonprofit that challenged the qualifications of Biggs, Gosar, and Finchem failed in two similar lawsuits against Congressman Madison Cawthorne (R-NC-11) and Congresswoman Marjorie Taylor Greene (R-GA-14). 

In addition to disqualification of the three legislators’ candidacy, Democrats have called for an investigation into their January 6 involvement. 

The leader of the activist movement challenging the results of the 2020 election, Ali Alexander of “Stop the Steal,” named Gosar, Biggs, and Finchem as three individuals who helped him organize the January 6 protest. 

One of the latest actions taken on these claims came last week when the U.S. House’s January 6 Committee requested that Biggs speak with them. 

Biggs refused to cooperate. He compared the committee’s intentions and tactics to those behind the Salem Witch Trials, with former President Donald Trump supporters being the target.

Border Crisis Continues With Record Numbers, Per November Report

The flood of illegal immigrants hasn’t slowed down in President Joe Biden’s border crisis, and it looks like it won’t anytime soon. According to Customs and Border Patrol’s (CBP) latest report, over 173,600 illegal immigrants were apprehended at the border in November — up nearly 5.5 percent from the previous month. The Office of Field Operations (OFO) accounted for much of that jump, reporting a 40 percent surge.

The majority of the fiscal year 2021 surge comes from single adults: nearly 64 percent. Less than 28 percent are family unit apprehensions (FMUA), and less than 8.5 percent are unaccompanied children (UC). 

On Thursday, Border Patrol (BP) Tucson Sector Chief Patrol Agent John Modlin showcased one of their latest catches: three illegal immigrants stuffed in the trunk of a sedan.

As AZ Free News reported, Modlin has consistently documented the reality of border apprehensions. 

Representative Paul Gosar (R-AZ-04) criticized the Biden Administration for their continued lack of resolve over the border crisis. Gosar pointed out that more illegal immigrants crossed the border in the last three months than in all of former President Donald Trump’s final year in office.

“Mr. Biden’s open border policies are an open invitation to criminals and drug cartels to cross into our country unchecked,” said Gosar. “The crisis has reached a new level and Yuma, Arizona in my district is ground zero, as hundreds of illegal aliens cross into Yuma daily and even more are staging along the border waiting to simply walk across. Yuma is under siege because Mr. Biden and Border Czar Kamala Harris are nowhere to be found. The first priority of the President of the United States is to protect the people of America. Sadly, Joe Biden puts Americans last and he has lost the trust of its citizens.”

Amid the ongoing crisis, Senate Parliamentarian Elizabeth MacDonough rejected efforts to grant amnesty to up to 7 million illegal immigrants through the $2 trillion budget reconciliation bill. Based on Senate rules and nearly two centuries of precedent, MacDonough determined that the amnesty effort wouldn’t be permissible; reconciliation concerns spending and revenue, though Democrats have attempted to argue that immigration relates to those two subjects. That was the third proposal on illegal immigrant amnesty brought before MacDonough, which would have allowed those here illegally since at least 2010 to apply for up to two five-year work permits. 

White House Press Secretary Jen Psaki called the ruling “deeply disappointing.” Psaki stated that their administration would continue working to secure amnesty.

“The decision by the parliamentarian is deeply disappointing and relegates millions to an uncertain and frightening future,” said Psaki. “Ultimately, it’s time for Congress to stop kicking the can down the road and finally provide certainty and stability to these groups, and make other badly needed reforms to our outdated immigration system.”

Conversely, the Federation for American Immigration Reform (FAIR) applauded MacDonough’s opinion. FAIR President Dan Stein criticized Democrats’ attempts to abuse the reconciliation process.

“For the third time, Senate parliamentarian Elizabeth MacDonough rejected attempts by Senate Democrats to use the budget reconciliation process to enact a sweeping amnesty for as many as 7 million illegal aliens. FAIR applauds Ms. MacDonough for her integrity and ensuring that longstanding rules of the Senate were not subverted to achieve partisan political ends,” stated Stein. “Sadly, Senate Democrats, who hold the majority in that body solely because Vice President Kamala Harris can cast the tie-breaking vote, have made repeated attempts to use budget reconciliation to make an end run around normal legislative procedures. We hope that this, her third rejection of these tactics, will finally put an end to their efforts to abuse the process in order to reward illegal aliens.”

Governor Doug Ducey has been working with Border Patrol to strengthen enforcement. Earlier this month, he announced the Arizona National Guard would provide 24 personnel, six vehicles, four ATVs, and one helicopter to support the Department of Public Safety, as well as additional tactical assistance in hotspots.

Speaker Pelosi And ‘Squad’ Slam Congressman Gosar For Meme Anime Video

House Speaker Nancy Pelosi, members of Congress’ ultra-progressive Squad, and the rest of the Democratic Party took offense to a meme video tweeted Sunday and deleted by Congressman Paul Gosar (R-AZ-04), characterizing it as violence. The video was a parody of the intro for a popular anime show, Attack on Titan, superimposing Gosar’s face onto the protagonist, Eren Yeager, with both Congresswoman Alexandria Ocasio-Cortez (D-NY-14) and President Joe Biden depicted as two villains that Gosar as Yager attacks.

The faces of Congresswomen Marjorie Taylor Greene (R-GA-14) and Lauren Boebert (R-CO-03) were also superimposed onto protagonists, too – the only two other Republicans featured in the video were Congressman Matt Gaetz (R-FL-01) and former President Donald Trump. The video also incorporated clips of the border crisis and Border Patrol. Toward the end of the video, there are pictures of Gosar with his enemies: Biden, Pelosi, Vice President Kamala Harris, and NIH Director Dr. Anthony Fauci.

Pelosi called for the government and police to investigate Gosar for the meme as a threat of violence.

“Threats of violence against Members of Congress and the President of the United States must not be tolerated,” tweeted Pelosi. “@GOPLeader should join in condemning this horrific video and call on the Ethics Committee and law enforcement to investigate.”

Pelosi’s remarks came the morning after the rallying cry of the Squad, a majority of whom tweeted similar condemnations in near-succession on Monday night.

Congresswoman Rashida Tlaib (D-MI-13) demanded that Republicans control Gosar.

“His party must reign him in. Fantasizing about killing a colleague is dangerous, deranged, and promotes violence,” wrote Tlaib.

Congresswoman Cori Bush (D-MO-01) called the meme “violent bigotry” that endangered people.

“Every day these white supremacists push the limits further and further to see how far they can go without consequences,” asserted Bush. “This puts lives in danger. Enough with the violent bigotry. Expel this white supremacist clown.”

Congresswoman Ilhan Omar (DFL-MN-05) insinuated that Gosar should step down or be removed from his seat.

“This man should not serve in Congress. Fantasizing about violently attacking your colleagues has no place in our political discourse and society,” wrote Omar.

Ocasio-Cortez tweeted that the video was a fantasy of a man who fundraises for Neo-Nazis killing her, and lamented that this was another attack on women of color that wouldn’t face consequences.

“So while I was en route to Glasgow, a creepy member I work with who fundraises for Neo-Nazi groups shared a fantasy video of him killing me. And he’ll face no consequences [because] @GOPLeader [Kevin McCarthy] cheers him on with excuses. Fun Monday! Well, back to work [because] institutions don’t protect [women of color.] Remember when [Republican Florida Congressman Ted] Yoho accosted me on the the Capitol and called me a f*****g b***h [?] Remember when Greene ran after me a few months ago screaming and reaching[?] Remember when she stalked my office the first time with insurrectionists & ppl locked inside[?] All at my job and nothing ever happens[.] Anyways, back to business[.] This dude is just a collection of wet toothpicks anyway. White supremacy is for extremely fragile people and sad men like him, whose self concept relies on the myth that he was born superior because deep down he knows he couldn’t open a pickle jar or read a whole book by himself.”

After the majority of the Democratic Party lobbed their condemnations against Gosar, the congressman tweeted another meme Tuesday morning alluding to left-wing reactions over the deleted video.

The meme featured two popular characters, “Crying Wojak” and “Yes Chad,” in a combination template called “Soyboy vs. Yes Chad.” The former character typically represents a frustrated male that is perceived as more woke, liberal, and soft – hence the term “soyboy.” In this meme, it’s supposed to represent the Democrats outraged by the meme.

The latter character typically represents a masculine man comfortable in his beliefs, depicted as more conservative, rational, and strong. In this case, Yes Chad represented Gosar.

“You’re [sic] cartoon scares me with your jet pack[,] flying[,] and light sabers [sic],” says the Soyboy, with the Yes Chad responding: “It’s a cartoon. Relax.”

This week marks a shift in public discourse over the meaning and significance of memes. On Tuesday, the Department of Health and Human Services (HHS) classified meme culture as “misinformation” that “poses an increasing danger” in newly-published guidance addressing COVID-19 information. The toolkit also alluded to satire as “misinformation.”

Representatives Gosar, Biggs Voted Against Hastening Visas for Afghans Fleeing Taliban

Last month, Representatives Paul Gosar (R-AZ-04) and Andy Biggs (R-AZ-05) voted against expediting visas for Afghans fleeing the Taliban. The Averting Loss of Life and Injury by Expediting SIVs Act (ALLIES) Act applies to Afghans that assisted the U.S. in the war: this includes interpreters, contractors, and security.

The ALLIES Act ensured that Afghans could receive special immigrant visas more quickly by removing certain application requirements, namely the proof that the applicant was currently experiencing or had experienced an ongoing serious threat due to their employment with the U.S. government. Instead, Afghans could apply if they believed there existed the possibility of a serious threat. The act also increased the number of available visas by 11,000.

Gosar explained that he is more focused on bringing Americans home safely. He argued that this should be the first and only priority, before assisting Afghans.

“How many US citizens are trapped in Afghanistan? I don’t see reliable info on this. It’s critical we get our people out safely,” said Gosar. “It’s not critical to use planes to bring Afghans here.  To see our transports full of illegal aliens and not US citizens is immoral.”

Although the ALLIES Act was introduced in a bipartisan manner, 16 House Republicans voted against the measure.

In addition to Gosar and Biggs, “no” votes on the ALLIES Act included Representatives Lauren Boebert (R-CO-03), Mo Brooks (R-AL-05), Scott DesJarlais (R-TN-04), Jeff Duncan (R-SC-03), Bob Good (R-VA-05), Marjorie Taylor Greene (R-GA-14), Kevin Hern (R-OK-01), Jody Hice (R-GA-10), Thomas Massie (R-KY-04), Barry Moore (R-AL-02), Scott Perry (R-PA-10), Bill Posey (R-FL-08), Matthew Rosendale (R-MT), and Chip Roy (R-TX-21).

Congressman Gosar Debuts ‘Gosar Minute’ News; Twitter Shadowbans As ‘Sensitive Content’

Representative Paul Gosar, DDS (R-AZ-04) debuted a new series on Sunday to keep his constituents in the loop: “The Gosar Minute.” The series offers fast-hitting facts, commentary, and solutions for current issues, presented by Gosar’s staffers in the style of traditional broadcast journalism.

Gosar’s latest series may be difficult to find, however. AZ Free News discovered that Twitter has hidden the tag #GosarMinute under its “Sensitive Content” setting. Any users searching for #GosarMinute on Twitter with their search settings hiding sensitive content won’t be able to find those Gosar Minute posts. However, users will be able to locate the Gosar Minute postings on Gosar’s congressional Twitter page.

Twitter says that “sensitive media” may fall into the following categories: graphic violence, adult content, violent sexual content, gratuitous gore, and hateful imagery.

The premiere episode featured Gosar’s intern, Faith Graham, discussing how Department of Justice (DOJ) Attorney General Merrick Garland refused to meet with Gosar and Representatives Louie Gohmert (R-TX-01), Marjorie Taylor Greene (R-GA-14), and Matt Gaetz (R-FL-01) to discuss the mistreatment and physical abuse of those imprisoned for nonviolent offenses committed at the Capitol on January 6.

“Today I am launching ‘The Gosar Minute.’ My team will discuss current events in short one minute clips and my take or involvement in them,” wrote Gosar. “Today’s topic is my recent visit to the DOJ with @RepMTG @RepMattGaetz @replouiegohmert ENJOY!”

Gosar’s affiliate, Beni Harmony, presented Wednesday’s Gosar Minute. The latest episode focused on President Joe Biden’s border crisis and Gosar’s proposed solution: a ten-year pause on all immigration at the southern border to stymie issues caused by the unchecked influx of illegal immigrants.
