Arizona’s frontline status with the crisis at America’s southern border led to a surprise, influential visitor this week.
On Wednesday, Florida Governor Ron DeSantis, in his official capacity, traveled to the southern border in Sierra Vista, alongside his Attorney General, Ashley Moody, who has been instrumental in filing many lawsuits against the federal government.
DeSantis convened two roundtables with a number of sheriffs from Arizona, Florida, and other states, listening to their stories and talking about solutions to mitigate the worsening crisis at the border.
After the meetings at Cochise College, Sheriff Mark Dannels, a national leader on border security and local enforcement, escorted his out-of-state guests to the border, where they gained a fresh, first-hand perspective of the deteriorating situation.
In a release sent out by the Florida Governor’s Office, Governor DeSantis used the visit to “highlight Florida’s successful actions to combat illegal immigration within the state and along the southern border.” Those measures include “new methods for combating human smuggling and drug trafficking across state lines and the relocation of illegal aliens who wish to be transported to so-called sanctuary states and cities.” DeSantis also announced that “Florida’s law enforcement agencies are offering trainings for other states that want to follow Florida’s lead on protecting citizens from the impacts of Biden’s Border Crisis.”
The second-term Sunshine State governor issued the following statement in conjunction with his mid-week stop in the Grand Canyon State: “Joe Biden is derelict in the performance of his duties and refuses to uphold the borders of our nation. In Florida, we’re stepping up even as the federal government falls down on the job. We enacted strong legislation to combat illegal immigration, sent law enforcement officers and equipment to the border, and have dedicated resources to divert migrants to sanctuary jurisdictions. Today we’re taking Florida’s no-nonsense approach to border enforcement nationwide.”

Dannels was extremely complimentary of the Florida team that descended on his county, appreciating their efforts to partner with him and other members of law enforcement, saying, “This is not about politics, folks. This is about doing what is right, which everyone in this room that works for government has taken an oath to do. So thank you guys for what you do. We pledge to you both and all our governors, all our sheriffs, all our law enforcement, our prosecutors, our county attorneys, our mayors to work united to fix these borders, secure our borders, and get America back.”

Another Arizona sheriff, P.J. Allred of Graham County, was at the table with the Florida chief executive and gave the following remarks: “When most people come from the south to come to the United States, my little county is probably not their destination, but they come through us and we feel them when they come through us. When we’ve encountered them after a pursuit through the desert, when they see us as law enforcement and the vehicles come to a stop, they run to us as law enforcement to get away from the coyotes that were carrying them. I appreciate all of you for being here, being interested in our country, our freedoms, our rights.”
At least two state legislators appeared to be in attendance for DeSantis’ southern Arizona check-in: House Speaker Ben Toma and Representative Gail Griffin. Toma tweeted a picture with DeSantis, writing, “My pleasure to help welcome Governor Ron DeSantis to Arizona and to share details of our border crisis. Glad to hear we share the same determination to secure the southern border once and for all.”

Democratic presidential candidate Robert F. Kennedy, Jr., visited Arizona farmers on Tuesday to discuss the impact of the border crisis on their livelihood.
Kennedy made the trip to Yuma, the area hardest hit by the border crisis. Yuma County provides 90 percent of the nation’s winter produce.
“The tsunami of migrants walking across farm fields and defecating in irrigation canals threatens the safety of that food supply,” stated Kennedy. “Last year, one of their neighbors had to plow under 88 acres of broccoli and personally absorb the $10k per acre cost after migrants tainted irrigation water.”

These past two years of President Joe Biden’s border crisis, illegal immigrants have caused millions of dollars in damages to farmers’ fields, often forcing farmers to eat the loss. Illegal immigrants hide in the fields, trampling produce and leaving mountains of garbage and human waste in their wake.
The filth has forced farmers to go to expensive, massive lengths to salvage their crops. In some cases, food safety laws force farmers to destroy their crops.

Prior to visiting with the farmers, Kennedy went to observe the border personally. He captured a typical scene of the border on video: a steady stream of migrants coming in outside of legal ports of entry.

Yuma County Sheriff Leon Willmot told Kennedy that solutions to the border crisis shouldn’t be partisan.
“This shouldn’t be a partisan issue, it’s a health and public safety issue. It’s a humanitarian crisis,” said Willmot.

Kennedy — the son of U.S. attorney general and senator Robert F. Kennedy, and nephew of former President John F. Kennedy — has had a lengthy career in the political realm, much like the rest of his family. Much of his life’s work has been steeped in environmentalism and health advocacy.
Kennedy arrived at the border on the 55th anniversary of his father’s assassination; just one day prior to the elder Kennedy’s death all those years ago when he won the California and South Dakota primaries for the presidency.

Kennedy, known for his extensive advocacy against major childhood vaccines, further rose to prominence over the course of the pandemic for challenging the safety and efficacy of the COVID-19 vaccines.
Kennedy announced his presidential run in April.
Under Biden, there have been over 5.3 million border encounters and over 1.5 million estimated gotaways. Based on the monthly average of encounters, there may be 9.1 million illegal immigrant encounters by the end of 2024.

As the border crisis continues to worsen after the end of Title 42, Arizona House Republicans are crying out for action and assistance.
Last week, Arizona House Republicans used the Title 42 news from the border to highlight the need for more federal and state efforts to enforce the nation’s laws and defend innocent American families and communities. The House Republican Majority issued a statement demanding that “federal leaders end the border crisis and protect states.” Then five Representatives sent a letter to Democrat Governor Katie Hobbs, “urging her to take immediate action and activate all available state resources to keep communities safe from the dangerous and unprecedented threats presented by an unsecure southern border.”
In the statement to the federal government, the House Majority leaders shared what Arizona had enacted to secure the border over the past three fiscal years:

“In 2021, House Republicans passed a Border Security Fund, which was used to help prevent human trafficking and illegal entry into the country, to solidify infrastructure, aid local prosecution efforts, and other necessary activities to protect Arizona citizens.
Last year we put over $500 million into the fund and allocated over $209 million for a variety of state and local border enforcement activities. About $240 million remains in the fund, which the state can use to counteract the federal government’s negligence on the border and the harm it has in our communities.
In the new state budget passed this week, we included:
– Maintaining a $30 million program that provides additional support to local law enforcement facing border-related crimes. (Border Drug and Interdiction Fund; Local Border Support – formerly known as the Border Strike Force)
– Adding $10 million to human trafficking prevention efforts.
– Adding $3 million for additional fentanyl prosecution efforts.”
In the letter to Governor Hobbs, the state representatives (Gail Griffin, Tim Dunn, Lupe Diaz, Michael Carbone, and Michele Peña) referenced former Arizona Attorney General Mark Brnovich’s legal opinion on “the federal government’s failure to uphold its duty to defend the States from invasion;” and a May 2022 Arizona House Legislative Proclamation, declaring that “an uncontrolled border is a security and humanitarian crisis,” and that “the smuggling of illegal drugs, weapons, and human beings poses a direct threat to our communities and innocent Americans.”

The five lawmakers wrote that “the State of Emergency in Arizona’s border counties that former Governor Ducey declared on April 20, 2021, is still in effect and continues as long as these conditions exist. And over $240 million remains in the Border Security Fund, which the Legislature established to prevent illegal entry into the country, solidify infrastructure, and combat other harms at the border.” They requested the governor “take immediate action and activate all available state resources to keep our communities safe from these dangerous and unprecedented threats.”

Nobody seems to know what to do about our illegal immigration crisis. Somehow, no other nation in the world seems helpless to control unlimited, illegal immigration. Democrats alternately claim it is being handled, and that it is the fault of uncooperative Republicans, who in turn can only agree that “something” must be done.
It’s time for a Great Reset, to rethink the basics of how we treat illegal immigration. Here’s an idea: Follow The Law. Just Say No.
It starts with refuting the notion that noncitizens, who have followed none of our rules for legal entry, have a natural right to come here anyway, and we have a corresponding duty to oblige them. Like all other nations, we have no such moral burden.
We make an effort to prevent entry for some. But most immigrants, when they reach American soil, are meekly processed through and provided food, shelter, and transportation into our country, as if that doesn’t incentivize their coming.
Among other obfuscations, open border advocates claim our immigration laws need a complete overhaul to mitigate our ongoing catastrophe. Nobody ever specifies exactly what those new laws are.
Reforms initiated by Democrats when Biden took office included eliminating the Remain in Mexico policy, and anything else with the taint of Trump about them. Predictably, conditions at the border worsened. The only “solution” Democrats have any interest in is amnesty, which is no solution at all.
We have adequate laws in place. Illegal immigration is already illegal. We just need to execute those laws.
Today, the operating principle of our immigration policy is sanctioned asylum fraud. Instead of a good faith effort to legally control our borders, illegal immigrants are coached to state “I am in fear,” and we pretend to believe them.
But accepting the same lie millions of times is simple abuse of asylum. Asylum, unlike illegal immigration, is a compassionate process administered internationally to provide safe harbor to individuals suffering persecution, or a credible fear of persecution, due to one of five specific causes: race, religion, nationality, social group, or political standing.
Persons claiming asylum have their cases heard in court. If they prevail, they are granted “indefinite” asylum with the tacit understanding that the asylum lasts until the threat is removed.
That’s a far cry from the daily mobs at our border, who, understandably, for economic reasons, would rather live in the U.S. than in their home country. It would be wonderful if we could save every person in the world living in poverty by bringing them here, but that’s not the way it works in our world of corrupt socialist autocracies.
But we can, and are, making our own country less safe and free, less fit to be a beacon of liberty under law to others.
In spite of the fact that only a minuscule percentage of the millions of asylum claims made at the border are ever substantiated, border patrol agents are instructed to continue to process them as potential claims with a deferred court hearing and release into the U.S.
Although the asylum status claims at the border are transparently bogus, the scofflaws rarely face consequences for failure to appear at their subsequent hearing. They will eventually be offered amnesty, then citizenship, then registration as a Democrat, if all works as planned.
There’s a better way, simple and legal. We should require all asylum claims to be made in their home country. Refugee processing centers could be established in the common countries of origin, where applicants would have their status determined. Unaccompanied minors at the border would be sent home.
This would greatly benefit legitimate asylum seekers. They could be assured of their status before beginning the journey to safety. The rest could be politely turned away at the border as the law requires. Word would quickly spread that the rules have changed. The crowds at the border would soon dissipate.
Americans are beginning to appreciate the stress unlimited migration places on our education, medical, and judicial systems. Barring a major course correction, it is bound to get much worse.
But we can end the misery if we just have the will to do so. Follow The Law. What a concept!

On Tuesday, Arizona succeeded in its effort to continue Title 42, a Trump-era activation of the policy enabling the rapid expulsion of illegal immigrants.
The Supreme Court (SCOTUS) on Tuesday blocked the D.C. District Court ruling last month ordering the Biden administration to lift Title 42 by Dec. 21. The policy will remain in place pending a hearing before the court on the question of whether states, including Arizona, may intervene to challenge the district court’s order.
Judge Emmet Sullivan, a Bush appointee, asserted that Trump’s initial implementation of Title 42 was unlawful. Although the Biden administration benefitted from the ruling, they appealed on Sullivan’s judgment of Trump’s use of Title 42.
BREAKING: The Supreme Court keeps the Trump-era Title 42 border policy in effect for now. The court says it will hear argument in February over whether red states can intervene in the litigation over the policy. The vote is 5-4, with Neil Gorsuch joining the three liberals.
Attorney General Mark Brnovich, who championed legal efforts to continue Title 42, said in a press release that this decision would ensure Americans’ safety where the Biden administration wouldn’t. Brnovich noted that Title 42 under the Biden and Trump administrations resulted in the expulsion of over 2.4 million immigrants.
“It’s disappointing [that] the Biden administration is willing to sacrifice the safety of American families for political purposes,” said Brnovich.
SCOTUS will fast-track the case for oral argument during its February session (Feb. 21 to March 1). Arizona and 18 other states petitioned SCOTUS last Monday to keep Title 42 in place, after the D.C. District Court denied their intervention.
One conservative-leaning justice, Neil Gorsuch, joined the liberal court’s opposition. Gorsuch wrote in his dissent, joined by Justice Ketanji Brown Jackson, that Title 42 should be done away with since the border crisis doesn’t quality as a “COVID crisis.” Justices Sonia Sotomayor and Elena Kagan also opposed the order, but didn’t join in Gorsuch’s dissent.
“[T]he emergency on which those orders were premised has long since lapsed,” wrote Gorsuch. “[The states] do not seriously dispute that the public-health justification undergirding the Title 42 orders has lapsed.”
Gorsuch rejected Arizona and the other states’ arguments that Title 42 should remain untouched since it was their only means of securing the border. He clarified that he found the states’ concerns about the border crisis valid, but repeated that Title 42 was meant only to curtail communicable diseases, not the other issues stemming from an unsecured border.
“[C]ourts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort,” wrote Gorsuch.
Title 42 of the Public Health Services Act has existed since 1944. The policy enables the Centers for Disease Control and Prevention the power to block illegal immigration into the U.S. to protect Americans from contagious diseases. This policy even applies to asylum seekers. Former President Donald Trump utilized the policy at the start of the COVID-19 pandemic.
A federal judge blocked the Biden administration from lifting Title 42 in May. However, requirements to keep the policy in place have curbed the border crisis little, with reports revealing that the Biden administration covertly subverts the policy regardless of court orders and public promises earlier this year.
