Nicole Solas, the Rhode Island mother who was sued by the nation’s largest teacher union for requesting public records, offered advice to Arizona parents facing similar transparency battles. As AZ Free News reported last week, Scottsdale Unified School District (SUSD) will post the names of individuals online who submitted records requests — an update that inspired controversy within the community.
The National Education Association of Rhode Island (NEARI), a teacher’s union, sued Solas last year for seeking records on Critical Race Theory (CRT) and gender theory from her child’s Rhode Island school. Not only was Solas sued — the school district attempted to charge Solas $74,000 for access to the requested records.
Solas advised Arizona parents to be loud and engaged until they achieved victory. Her examples of loud engagement were submitting public records requests and filing lawsuits. She advised that district officials would “fold like a paper tiger.” Solas offered the advice and discussed her ongoing legal battle on “Conservative Circus” with host James T. Harris on Tuesday.
Solas pointed out that parents speaking out at school board meetings serves to inform the public, which she says has a far greater impact on schools.
“Keep in mind that when you make public comment at school board meetings, you’re doing that to talk to, not the school board, you’re trying to talk to people that don’t know what’s going on,” said Solas. “You need to be brave.”

The Goldwater Institute, a Phoenix-based think tank and legal organization, represented Solas in the lawsuit, National Education Association of Rhode Island, et al. v. South Kingstown School Committee, et al. Most recently, the Rhode Island Superior Court denied Solas’ motion for summary judgment early last month.

On Thursday, the Arizona House approved two separate bills cracking down on divisive and adult content in K-12 schools: a bill banning critical race theory from curriculum, HB2112, and a bill outlawing sexually-explicit materials from schools, HB2495. Both passed along party lines, 31-28.
Both bills received a similar partisan reception when passed by the House Education Committee: in their opposition of the bills, Democrats doubted their efficacy and necessity, whereas Republicans championed their cause and applauded them.
Introduced by State Representative Michelle Udall (R-Mesa), HB2112 bans teachings rooted in the traditional, original definition racism: that one race, ethnic group, or sex is superior to any other, and that an individual’s race, ethnicity, or sex predetermines their moral character and makes them inherently racist, sexist, or oppressive. The bill also rings of Biblical wisdom: similar to what Ezekiel 18 imparts, teachers also may not assign guilt or lay blame on any student for the actions and events of others who share the student’s race, ethnicity, or sex. Additionally, the bill would reject teachings that academic achievement, meritocracy, or traits such as hard work ethic are racist or sexist. Violations of this legislation could result in teachers facing penalties such as suspension or the loss of their teaching certificate, and school districts receiving up to $5,000 in fines per violation.
The legislature’s previous attempt to ban critical race theory was struck down in court last year because it was integrated in a bill that the judge ruled was a violation of the single subject requirement of the state constitution.
Udall explained that she received “countless” pleas from parents on the divisiveness and harms caused by critical race theory teachings in public K-12 schools at present. She cited several specific examples; for one, a Red Mountain High School teacher required students to study the critical race theory terms “intersectionality,” “anti-racist,” and “restorative justice,” then write a self-reflection paper about their privileges. Another example concerned an Arizona State University (ASU) teacher preparation program assigning a book called “Nurture Shock,” in which one chapter discussed “why white parents don’t talk about race.” Yet another example concerned a social studies teacher in Glendale who sent her colleagues materials to discuss race in class, focusing in part on how white people have a greater burden for being anti-racist, such as understanding their privilege.
“This categorization and scapegoating will not heal racial divides. Instead, it emphasizes ethnicity and gender as insurmountable barriers to peace,” said Udall.
Udall then described the gaslighting parents endured when they contended the presence of critical race theory in classrooms: how parents were told their experiences were a one-off incident and that critical race theory isn’t being taught in schools, despite the National Education Association (NEA) repeatedly advocating for the theory after issuing a resolution last summer that they would make concerted efforts to instill critical race theory teachings in classrooms.
“These concepts should be things we can all agree on: that all men are created equal, that hard work and persistence pay off, that students of all races are capable of being held to a high standard of academic excellence,” said Udall.
Democrats’ arguments against the bill alleged that it would get in the way of teaching history. However, the bill didn’t outlaw teachings of certain history, such as slavery or Jim Crow laws — rather, the bill focused on conclusions and statements of fact imparted by critical race theory teachings.
State Representative Judy Schweibert (D-Phoenix) argued that critical race theory teachings imparted lessons of honesty, integrity, and freedom to pursue dreams.
“When we teach history, it’s not about assigning guilt or blame. It’s about teaching young people to think deeply and critically themselves so we don’t repeat the same mistakes,” said Schweibert.
State Representative Richard Andrade (D-Glendale) insisted that critical race theory teachings were “the truth.” State Representative Mitzi Epstein (D-Ahwatukee) said that she agreed that “the sins of the father shouldn’t be visited on the children” and appreciated the intent of the bill, but feared that the bill’s wording would prevent teachers from placing any blame on anybody.
HB2495 bans the sexual explicitness of materials given to K-12 students. State Representative Jake Hoffman (R-Queen Creek) introduced the bill. It would prohibit K-12 public schools from exposing or referring students to “sexually explicit material,” which was defined as depictions of sexual conduct such as masturbation, intercourse or physical contact with a person’s clothed or unclothed genitals, public area, buttocks, or a female’s breast; sexual excitement, meaning the sexual stimulation or arousal of human male or female genitals; and ultimate sexual acts, such as any form of or allusion to intercourse, fellatio, cunnilingus, bestiality, or sodomy.
The bill passed with Udall’s amendments to exempt classical literature, early American literature, and books required for a course awarding college credit, but only with written parental consent prior to exposure of each material. If parental consent can’t be obtained, the school must furnish the student with an alternative assignment without sexually explicit material.
“This is simply a practice that I believe a majority of Arizonans don’t want. I don’t believe that they want sexually-explicit material shown to their children,” said Hoffman.
In rebuttal, Democrats argued that there were already laws prohibiting inappropriate materials from being shown to children. They insisted that they were equally opposed to showing children pornography in schools.
Schweibert argued that parents didn’t have a right to determine what other people’s children were to learn — even in this case. She asserted that the legislature was “treading on dangerous territory” tantamount to instigating a book burning movement. Schweibert cited bans on historically revered books like “To Kill a Mockingbird,” “Of Mice and Men,” and the Bible; however, those were the doing of left-leaning groups, often with blessings from Democratic leaders.
Both bills now head to the Senate for consideration.

The Arizona Senate Education Committee passed a bill to ensure K-12 schools afford greater transparency to parents concerning the content and adoption procedures for curriculum and all other learning materials. The bill, SB1211, passed 5-3 along party lines. 20 states have introduced similar legislation; the Wisconsin legislature passed a similar bill last year but their governor vetoed it; most recently, the Indiana House moved another similar bill forward. However, no other state has the same legislative language as SB1211.
Specifically, the 14-page bill would require schools to post online in a searchable manner all learning material adoption procedures as well as the content organized by subject, grade, and teacher. The specified learning material covered requires readings, videos, audio, digital materials, websites, instructional handouts, worksheets, apps, assemblies, guest lectures, civics assignments or projects, and service learning projects. Any educational materials concerning nondiscrimination, diversity, equity, inclusion, race, ethnicity, sex, gender, bias, action-oriented civics, service learning, or social and emotional competencies must be referenced in full online at least 72 hours before implementation. Materials outside that scope must be posted online within a week of their implementation and remain accessible on the site for two years. The bill also would require schools to allow all throughout the school day as well as a half an hour before and after school hours for textbook review prior to adoption.
Parents could seek redress for violations of this bill by first submitting a complaint to the school principal. If the principal doesn’t investigate and respond within 15 days, or the response doesn’t solve the issue satisfactorily, parents could submit a complaint to their school board. If the board doesn’t respond adequately or at all within 25 days, then parents may take legal action against the school’s governing body. No teachers would be subject to punishment.
State Senator Nancy Barto (R-Phoenix) insisted all she was introducing was a “simple […] common-sense transparency bill.” Barto clarified that the bill would allow parents a heads-up about what their children would learn.
“So many parents are so frustrated at not having access to what their children are learning in schools. There are so many things that are accessible online now, and curriculum needs to be one of them,” said Barto.
Parent after parent highlighted personal and local incidents concerning willful lack of transparency from their schools and districts. In addition to parents, the Arizona Coalition of School Board Members and Heritage Action for America showed up to support the bill. A handful of teachers, most of them masked, and the Arizona Education Association (AEA) spoke out against the bill. They argued that the bill would create an undue burden on teachers and districts, foster distrust and malcontent between parents and teachers, and even further reduce educational quality. The Arizona Charter School Association (ACSA) was also reportedly against the bill, according to State Senator Gonzales, but none of their representatives gave testimony before the committee on Tuesday.
The first to provide public commentary on the bill was none other than Nicole Solas — the Rhode Island parent sued by her state’s teacher’s union, the National Education Association of Rhode Island (NEARI) for her public record requests and represented by the Goldwater Institute, the Phoenix-based conservative public policy and litigative think tank.
Solas told the committee that her story was a cautionary tale of what occurs when a state doesn’t have academic transparency. Her story began when she requested information about the education her daughter would receive, and learned that the school taught about gender at every grade level in “age-appropriate ways,” as well as teaching five-year-olds on the first day of Thanksgiving what could’ve been done differently during the pilgrim’s Thanksgiving. When Solas attempted to ask more questions about the curriculum, her school told her to submit public records requests. After doing so, the school board of her district put her name on the agenda of a public meeting with a threat to sue her for her records requests.
Solas recalled how the five hour meeting was filled with public harassment and open debates on her moral character and motivations by the board members. Solas shared further that her district then hired a public relations firm to defame her in the national media. The local teacher’s union then decided to sue Solas for filing those records requests. Even after enduring all of that eight months later, Solas said her original requests have gone unanswered. All she received was outdated curriculum; the district told her she hadn’t asked specifically for the current curriculum.
“What they did to me was government abuse of power just because I wanted to know what was being taught,” said Solas. “This is a kafkaesque, bureaucratic problem with a very easy academic solution.”
It wasn’t just the blame from the district that presented a problem to Solas — it was the cost of the records requested. Solas insisted that the cost to districts to fulfill public records requests was unnecessary, and that public schools needed to be protected from squandering their education dollars.
“Pass this bill for public schools and you can save them from themselves. We need our education dollars to be spent on students, not on a petty stand-off between schools and parents,” said Solas. “These are the games they play with public records requests. Our children’s education is not a game.”
Majority Leader Rick Gray (R-Sun City) said Solas’ story was heartbreaking to hear, and expressed condolences for the plight of New Jersey’s children.
“They wanted to send a message that if you want transparency […] they will retaliate against you and punish you for asking for transparency,” relayed Solas.
State Senator Christine Marsh (D-Phoenix) asked Solas if New Jersey had a parental bill of rights similar to Arizona’s. She added that she didn’t understand what Solas’ issue had to do with Arizona schools. Solas said they don’t have anything like that in her state, and informed Marsh that the Phoenix-based Goldwater Institute is representing her for the lawsuit.
Goldwater Institute Director of Education Policy Matt Beienburg offered insight from Arizona teachers in support of the bill. He read a letter from Jessica, an English teacher, who described how she covered over 70 absences in one week and insisted on the bill because it provided an “easy safeguard” for creating a “workshop” between families and schools.
“This bill is pro-student, pro-parent, and pro-teacher,” asserted Beienburg.
State Senator Tyler Pace (R-) asked what a pragmatic solution would be, instead of this bill. Thomas said the best solutions would be at the local level. He said parents already had “a lot of tools” to get the transparency they need.
“The unintended consequence of this is that kids are going to suffer in that their interests aren’t going to be explored at any given instance during the day,” asserted Marsh.
Gray pressed AEA President Joe Thomas, who insisted that better answers were to be had, to give them a tangible solution. Thomas couldn’t. Instead he repeated that parents had the tools to investigate the curriculum themselves. Gray insisted that wasn’t enough of an answer.
“When we see this as a legislative body and this is brought to us, it is our responsibility to see what we can do to solve this problem. Ideally we would never get this problem here because the schools would take care of it,” responded Gray. “We don’t have any solutions from the education industry, but we clearly have problems from the parents.”
In closing public remarks, Beienburg cited how an AEA spokeswoman last year reported that she submitted curriculum materials regularly to her district officials for review.
“That’s indicative of the fact that this is doable,” said Beienburg.

Arizona educators have a new resolution to kick off 2022: a return to remote learning and school closures, with the struggle over school funding placed on the backburner temporarily. Teachers unions are calling for schools across Arizona to hold off on in-person learning for another two weeks due to the holiday spike in COVID-19 cases.
Arizona Daily Independent reported on a key player in the push to pause in-person learning: Rebecca Garelli. She was also a critical player in the establishment of RedforEd, a teachers union activist movement, and a founding member of Arizona Educators United (AEU), a local affiliate of the National Educators United (NEU). AEU’s domain is defunct currently, though their Facebook page remains active.
Garelli encouraged people to sign onto a letter from NEU to delay school openings for another two weeks.
The letter was published the same day AEU published the results of a “Return to Safe Schools” survey by RedforEd to determine support for school reopenings.
Of the nearly 500 responses from Arizona educators and community members spanning 81 different school districts and charter schools, 56 percent said “yes, with reservations” to reopening, about 24 percent said “no,” about 18 percent said “yes,” and about three percent qualified as “other” responses. Concerning work-related stress attached to in-person work: about 39 percent were “extremely stressed,” about 28 percent were “moderately stressed,” about 11 percent were “mildly stressed,” about 11 percent were “typical[ly] stress[ed],” and about 10 percent were “not stressed at all.
The Arizona transplant came from Chicago, where she made tens of thousands more — at least about $12,800 more —while working as a middle school math and science teacher in Chicago Public Schools (CPS) than she has in Arizona. According to open records, Garelli made around $80,800 a year as a middle school teacher and for three years an additional estimated $7,400 as a CPS consultant, then $69,000 with the Arizona Department of Education (ADE).
NotInOurSchools reported Garelli’s hire and relocation to Arizona following the appointment of Kathy Hoffman, the current Arizona Superintendent of Public Instruction. Garelli also serves on the Democratic Socialist Labor Commission Steering Committee.
The unionists’ timing this year to strong-arm a halt on returning to classrooms wasn’t novel. Last New Year’s Eve, Garelli suggested educators take coordinated “sickouts” and “other actions” on behalf of NEU.
This year, Garelli promised that she wouldn’t be sending her children to school “anytime soon” due to the increase in COVID-19 cases.
Another key player in the RedforEd founding, Arizona Education Association (AEA) President Joe Thomas, also called for remote learning. The AEA is a state affiliate of the National Education Association (NEA).

Garelli, Thomas, and Dylan Wegela led AEU, which oversaw and organized the RedforEd movement. Noah Karvelis — a Littleton Elementary School District (LESD) music teacher quickly appointed as president of the Littleton Education Association (LEA), a local AEA affiliate, and AEU co-founder — told the Shanti Journal in a 2018 spotlight interview that RedforEd started as a Twitter exchange between him and Thomas. That interview has since been removed from the journal’s website.
“RedforEd is a movement to increase funding for education in Arizona. The primary goal is to restore the $1.1 billion in education funding cuts. It all started with a tweet between myself and Joe Thomas discussing what the climate among educators in Arizona was like,” stated Karvelis. “Ultimately, we decided to have me start a RedforEd day.”
December of 2020, the NEA claimed that mitigation measures like remote learning were far more important than the effects they had on schoolchildren. The association claimed that the children were “resilient.”
“Yes, it’s been difficult. There is learning loss. There are social-emotional challenges. In some cases, there is sickness, economic hardship, or trauma,” wrote the NEA. “But students are extremely resilient.”

Last October, the American Academy of Pediatrics declared that the current state of youth mental health qualified as a national emergency.
The next month, Education Secretary Miguel Cardona and Surgeon General Vivek Murthy published an opinion in USA Today urging schools nationwide to keep schools open. They cited the 50 percent decline in child and adolescent COVID-19 cases nationwide from late last August to late October.
“[I]t’s on adults to recognize that our highest responsibility to children and youth is to lift up their needs; equip them to be physically, mentally and socially healthy; and give them a chance, at long last, to thrive,” wrote the two officials.
Scottsdale Unified School District (SUSD) allows students to replace their legal birth names, called “deadnames,” on their IDs with their preferred names. The district folded to a push from a Gender & Sexualities Alliance (GSA) chapter at Cocopah Middle School: these clubs are part of a national network pushing a hyperfocus on a child’s sexuality while engaging them in social justice activism.
One GSA middle schooler revealed SUSD’s “deadname” policy during a testimonial video featured at the latest annual fundraising award ceremony hosted by the Phoenix chapter of the Gay, Lesbian, & Straight Education Network (GLSEN, pronounced “glisten”: an activist organization pushing for comprehensive LGBTQ+ sex education and other social justice activism), called the Sparkle Glitter GLSEN Remote Fundraiser and Respect Awards. Arizona Daily Independent first reported on the video. The mother of the anonymous student was also present; her daughter revealed that her GSA club pushed SUSD to create a “deadname” policy. The young students were instigated and aided by a teacher serving as their club sponsor, Laynee Langner, whose efforts helped them cinch the award “GSA of the Year.”
“One of my friends, who is trans, had their deadname on their ID and we thought that was kind of unfair because everyone was calling them by their deadname,” complained the middle schooler. “We took it to district board level and got it changed for the entire district so that the entire district’s students could have their proper names on the ID.”
Langner explained that the students do what they want, when they want in their GSA. She further explained that school policy forbade students from using chosen names on their ID for proper identification reasons.
“Every single student has to wear their ID all day every day, and these have their ‘deadnames,’ and they wanted that changed. The consensus is that we can’t because it’s their legal names, and we need to have their legal names on their IDs. And I came back and told the students and they were so upset,” said Langner. “I haven’t seen such joy on the face of a child when I told them they didn’t have to have their ‘deadname’ on their ID, that they could have their chosen name on their ID. It was just euphoria, and it brought – it’s just bringing tears to my eyes right now.”
“Deadnames” are the birth names that individuals reject upon transitioning genders. The lack of a space between “dead” and “names” wasn’t an oversight – that’s the spelling recognized by activists, and even Merriam Webster. Activists also use the verb “deadnaming” to refer to the accidental or purposeful practice of using an individual’s legal birth name.
GSAs originated with GLSEN in the late 1990s. GLSEN, established in 1990, not only promotes the sexualization of children, it intertwines the tenets of Critical Race Theory (CRT) in its messaging. In guidelines for promoting inclusivity through a GSA, GLSEN wrote that having black representation in GSA leadership was necessary, and touched on topics like intersectionality, solidarity, centeredness, anti-racism, and white supremacy. It also insisted that GSA engage in social justice activism.
“If you’re discussing gender identity, talk about the gender binary as a white supremacist concept, and share information about some of the many African and Indigenous tribes that have embraced gender outside of the binary for decades,” read the post. “Have in-depth conversations in your GSA about intersectionality, solidarity, and anti-racism. These conversations are incredibly important, but you must also ensure that you do not place any undue burden on Black club members to share their trauma or to teach non-Black club members about racism. Provide space for Black people to process during or after these conversations, if needed, and make sure students know that they can step out at any point if they’re uncomfortable or triggered.”
Last year’s GSA Summit focused on a partnership with Black Lives Matter (BLM). The National Education Association (NEA) was also involved.
The club has caused deep divisions on campus in its short existence within SUSD, also mentioned during the Sparkle Glitter GLSEN Remote Fundraiser and Respect Awards testimonial video. The anonymous mother-daughter duo who revealed that the GSA sixth graders pushed SUSD to create a “deadname” policy described the divide their GSA caused at Cocopah Middle School. The mother said that their activism caused “a whole lot of problems” and said that some parents threatened to leave their middle school while others brought GSA cake to thank them.
“There was a very clear divide in the sixth graders. Those who participated were called ‘gay’ and those who didn’t participate were called ‘homophobic,’” said the middle schooler.
This is the same district formerly led by Jann-Michael Greenburg, the SUSD board member removed from presidency over his connection to a dossier on political and parental opponents created by his father.
One legislator, State Representative John Kavanagh (R-Fountain Hills), promised to intervene with a bill to require parental consent before a student can join a school club involving gender, gender identity, and/or sexuality, as well as require schools to give parents detailed information about those types of clubs. The representative asserted that the backdoor approach to sneaking in curriculum through clubs must come to an end.
“School districts should be serving the needs of families and students and not replacing their own ideologies with the beliefs of the parents. My bill would close a loophole that school districts have found in the state law that requires parental approval before students receive sex education,” explained Kavanagh. “They’ve taken LGBTQ+ politics out of the classroom and into the clubs to circumvent the law. My bill will require that parents consent to their child joining any kind of gender sexuality, or gender identity club before the students can join and the school will also have to send parents information about the club’s bylaws, rules, goals, and purposes.”
Jill Dunican, a Desert Mountain High School parent, told AZ Free News that it took her almost four months before she could get someone at her child’s school to tell her what GSA was all about after her high schooler told her about a “sexuality club” on campus. Dunican said that she recognized the harm posed by GSA immediately after obtaining more information on it.
“At first, the principal confirmed there was a Genders Sexuality Alliance, which she framed as a mere support group. However, it took almost four months before I was put in touch with the teacher who leads the GSA who was able to provide details about the agenda and source of curriculum,” said Dunican. “After reviewing the GLSEN website, it became clear how divisive the content is. These lessons are not something I want my children exposed to. Essentially, they ask kids to label each other based on skin color, gender and sexual identities in an effort to stack rank themselves into victim groups to establish the oppressors and the oppressed. I just don’t see how that helps any child.”
“Another concerning finding,” said Dunican, “was GLSEN’s instruction that teachers encourage students to become social activists for the abolishment of police, including school resource officers. In fact, GLSEN even promotes policing as a white supremist concept. In our home, we support police and first responders and value their contributions to the Scottsdale community.”
Dunican expressed that she’s not against providing emotional support to LGBTQ+ individuals or any children. Rather, Dunican has concerns that the GSA programming is indoctrinating children with a victimhood mindset and sexualized content that does not seem age appropriate, all without parental consent.
“I’ve heard others attempt to frame any criticism of the GLSEN indoctrination as anti-LGBTQ+. That’s simply not the case. If there was a Gay-Straight Alliance that truly promoted alliances and provided support, and didn’t push a sexualized ideology, I would be all in. Every child should be treated with kindness and respect, regardless of who they are. What GLSEN is pushing on our community and children is completely inappropriate.”
